A pet wet wipes consumer has sued Earth Rated alleging the wipes are falsely marketed as being “plant-based” when they contain synthetic and artificial ingredients.
Plaintiff Marat Martirosyan filed the class action complaint against Earth Rated on Nov. 5 in a California federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Earth Rated’s labeling is deceptive, leading buyers to believe they are purchasing a natural, environmentally friendly product. Earth Rated’s labeling also creates an unfair advantage over competitors by falsely appealing to consumers who prefer natural products, the lawsuit states.
Earth Rated is ‘greenwashing’ with its labels, lawsuit states
According to Martirosyan, many consumers look for plant-based products due to perceived health and environmental benefits.
“Through falsely, misleadingly, and deceptively labeling the product, defendant seeks to take advantage of consumers’ desire for a truly plant-based product,” Martirosyan states in the filing.
“Yet, defendant has done so at the expense of unwitting consumers, as well as lawfully acting competitors, over whom defendant maintains an unfair competitive advantage.”
The issue is a part of the ongoing debate over “greenwashing” in consumer products, where companies label products as environmentally friendly to attract buyers, the lawsuit states.
The Federal Trade Commission has issued guidelines for environmental marketing claims to prevent companies from misleading consumers, Martirosyan points out. His lawsuit claims Earth Rated disregarded these guidelines by promoting Earth Rated pet wipes as “plant-based” when they actually contain non-plant-based, highly processed ingredients.
As a result, Martirosyan is suing on behalf of anyone who bought the Earth Rated pet wipes in the United States.
He is suing for breach of warranty, unjust enrichment and violations of California consumer laws. He’s seeking certification of the class action, damages, fees, costs and a jury trial.
In June, Earth Rated reached an $825,000 class action settlement to resolve claims that its compostable poop bags were not actually compostable as promised.
