Noom Subscription Class Action Lawsuit Overview:

A federal judge in New York upheld a class action lawsuit against Noom, a popular health and wellness subscription-based diet app.
A total of 274 class action counts at a value of more than $100 million were reportedly sustained by Judge Lorna Schofield, who subsequently denied the company’s request for dismissal, according to a Tuesday order.
The class action lawsuit was filed by a Noom user who alleged the company engaged in an auto-renewal scheme that tricked customers who believed they were signing up for a trial period, but were unexpectedly slapped with new subscription fees when the trial ended.
Judge Schofield agreed that the Noom subscribers could not have reasonably known they were registering for more than a trial period based on the steps they had to go through to sign up to that point.
“This suit will prove that Noom engaged in one of the largest auto-renewal scams in American history,” a lawyer representing the plaintiff said in a statement.
“Consumers were led to believe that they were enjoying a free trial period but instead were charged for an entire year’s worth of service. To make matters worse, Noom failed to provide any reasonable way to cancel or get a refund.”
Noom Subscriptions Unexpectedly Renewed
Plaintiff Geraldine Mahood first filed the Noom subscription class action lawsuit in May of last year. Mahood alleged she was unable to cancel the subscription before the end of her $10 14-day trial period, resulting in her automatically being enrolled in the full service at a cost of $99.
The class action lawsuit alleges Noom also misled consumers by charging them non-refundable fees of up to $199 for multi-month diet programs they didn’t ask for or use.
Noom has received a total of $560 million in investments from celebrities and venture capitalists over the years, including tennis-star Serena Williams, Sequoia Capital, and Silver Lake.
The company is heading towards an IPO led by Goldman Sachs later this year.
A similar class action lawsuit was filed against The Washington Post alleging deceptive automatic renewal terms. A California district ruled last month that the $6.7 million class action lawsuit could move forward.
