
Republic Services Recycling Class Action Lawsuit Overview:

A Montana woman has filed a class action lawsuit against Allied Waste Services of North America LLC d/b/a Republic Services, claiming the company makes false promises about the materials it can recycle.
Plaintiff Keila Cross of Missoula alleges that she looked up her address using a form on Republic’s website that purported to show what materials could be recycled in her area. The website claimed that Republic Services would recycle a variety of paper, steel, aluminum and plastic products, including household plasticsNos. 1-7.
Based on this information, Cross says she decided to become a customer of Republic’s curbside recycling services.
However, Republic Services has allegedly implied that it does not actually recycle all of the materials that it claims to recycle. Cross points to an article published on Oct. 30, 2020, in the Missoula Current in which representatives for Republic seem to state that plastics Nos. 3-7 are nearly impossible to recycle.
Lawsuit Alleges Republic Services Does Not Recycle Many Plastics
Also in 2020, Republic published a report claiming that it believes Nos. 3-7 plastics are “end-of-the-line” plastics that should be placed in a landfill, Cross alleges in the lawsuit.
“Put another way, many of the products Republic Services collects and purports to recycle are sent directly to the landfill–the same place residential garbage collection ends up,” the class action lawsuit states.
Cross complains that Republic Services does not notify customers that many of the household plastics it collects in its recycling bins “have essentially no prospect of ever being recycled.”
The lawsuit argues that the company’s actions are “immoral, unethical, oppressive, unscrupulous or substantially injurious to consumers” and violate the Montana Consumer Protection Act.
The proposed class includes all Republic Services residential customers in Montana who have paid for curbside recycling in the last two years.
