A class action lawsuit claims that E. Mishan & Sons Inc.’s Gotham Steel cooking pans are not non-stick, despite advertising to the contrary.
Carl Mack and Alec Gable say they each purchased pans made by the company specifically because they saw advertisements that the pans were non-stick.
Mack claims he relied on the packaging of the product and the TV advertisements to make his purchase, which both marketed the product as non-stick.
Allegedly, the commercials for the pan advertised that no butter or oil was required.
Mack says that he used the pans without oil or butter, consistent with advertisements for the product. However, food allegedly began sticking “severely” to the pan within a month of Mack’s purchase of it and he stopped using the pan.
Gable says he purchased two pans from the Gotham Steel website in 2018. Allegedly, he decided to purchase the pans because, like Mack, he saw advertisements showing that they were non-stick.
Gable claims that after two uses, he began cooking with butter and oil, but even the use of butter and oil did not prevent the food from sticking. Allegedly, the pans were “often caked with black burn marks” and Gable got rid of the pans after about a month of use.
The Gotham Steel non-stick pans class action lawsuit says that Gable and Mack’s experiences are common to many customers even though they used the pans as directed.
The Gotham Steel non-stick pan false advertising class action lawsuit says that E. Mishan & Sons Inc. knew or should have known that the pans were not non-stick as claimed, citing numbers customer complaints about the issue.
Allegedly, E. Mishan & Sons Inc. violated the New York General Business Law, which prohibits “deceptive acts or practices in the conduct of any business, trade, or commerce or in the furnishing of any service” in the state, and also prohibits false advertising.
The customers say that they were financially injured by E. Mishan & Sons Inc.’s misrepresentations of the Gotham Steel pans because had they been aware that the pans were not actually non-stick, they would not have purchased the pans or would not have paid as much as they did for them.
The non-stick pan class action lawsuit aims to hold the company liable for breach of express warranty, among other claims.

Bought two pans from Costco because they’re supposed to be nonstick. I have black marks all over them and there doesn’t seem to be any way to scrub them off.
I bought Gotham steel saute pan from Wal-Mart. Worked fine the first few months. Now I have these ugly horrific black stains and swirls on my pan and they don’t come off.
Everything sticks to these pans. We thought maybe they were supposed to be like a cast iron pan as everything inside the Ian turned black and could not be removed. We purchased our pans approximately a month ago at Costco and plan to return them.
I bought two sizes of these frying pan less than a year ago, at Bed Bath and Beyond they are terrible everything burns black on it and is hard to wash off, I am ordering different pans and throwing these away. What a waste of money.
I just saw this and about two or so months ago I purchased a gotham steel pan, the latest that they advertise in 2020. Even on low heat the food stuck without some kind of oil or butter. It was very frustrating and even though they say you can use metal utensils, which mine have NO sharp edges at all, I noticed a bunch of scratch marks. If I had known this information before, I would have never purchased it. I did not spend tons of money on it but, I spent enough that I would have rather bought something that actually did what it advertised. I also bought a copper chef and the same issue, the food stuck without something. I know that things do not last forever but, it has not even been half a year and things are going wrong. I still use it cause I had gotten rid of my other pans due to the way it was advertised.
So, just a warning to anyone that reads this, I had the same issues as others.
Bought the pans and thought they were the best!!! After using for a couple of months everything sticks to them. So not what they claimed them to be!!
I also purchased the Gotham 2 piece set at Costco. From the first time I used it, everything sticks. I used small amount of oil and still the sticking continues. These pans are advertised as completely non stick and no oils required, however this is not the case. I feel I have been mislead.
You have to use it on almost the lowest heat setting.
Food sticks to my pans. Some of the pans have nicks in them. I can’t use them. I regret ever buying these pans.
Purchased a Gotham steel set and at first they were wonderful but within a month the food started to stick. Now I hate the set. Can’t wait to replace it.
I bought my set of 2 frying pans at Costco in October of 2019. For a while, they worked very well, but eventually food now sticks to them and is very hard to get off. Same issue everyone else is seeing.
I have had my pan for about a year. For most of that year it worked great. Now all of a sudden there are small bits of food stuck to the surface which makes it rough and everything is starting to stick. Seems to be no better than any other non stick, but at 2 to 3 times the price.
