gotham steel non-stick panA class action lawsuit claims that E. Mishan & Sons Inc.’s Gotham Steel cooking pans are not non-stick, despite advertising to the contrary.

Carl Mack and Alec Gable say they each purchased pans made by the company specifically because they saw advertisements that the pans were non-stick.

Mack claims he relied on the packaging of the product and the TV advertisements to make his purchase, which both marketed the product as non-stick.

Allegedly, the commercials for the pan advertised that no butter or oil was required.

Mack says that he used the pans without oil or butter, consistent with advertisements for the product. However, food allegedly began sticking “severely” to the pan within a month of Mack’s purchase of it and he stopped using the pan.

Gable says he purchased two pans from the Gotham Steel website in 2018. Allegedly, he decided to purchase the pans because, like Mack, he saw advertisements showing that they were non-stick.

Gable claims that after two uses, he began cooking with butter and oil, but even the use of butter and oil did not prevent the food from sticking. Allegedly, the pans were “often caked with black burn marks” and Gable got rid of the pans after about a month of use.

The Gotham Steel non-stick pans class action lawsuit says that Gable and Mack’s experiences are common to many customers even though they used the pans as directed.

The Gotham Steel non-stick pan false advertising class action lawsuit says that E. Mishan & Sons Inc. knew or should have known that the pans were not non-stick as claimed, citing numbers customer complaints about the issue.

Allegedly, E. Mishan & Sons Inc. violated the New York General Business Law, which prohibits “deceptive acts or practices in the conduct of any business, trade, or commerce or in the furnishing of any service” in the state, and also prohibits false advertising.
The customers say that they were financially injured by E. Mishan & Sons Inc.’s misrepresentations of the Gotham Steel pans because had they been aware that the pans were not actually non-stick, they would not have purchased the pans or would not have paid as much as they did for them.

The non-stick pan class action lawsuit aims to hold the company liable for breach of express warranty, among other claims.

  1. Harley Farrell says:

My boyfriend bought me a set last year for Christmas. At first they were great. Less than a year in, the medium pot started to discolor and everything was sticking. Cant even fry an egg in any of the pans bc they stick and bust. They’ve always been hand washed with a nonabrasive sponge or rag and never used anything other than silicone or wooden utensils in them.

  2. Jackie Singer says:

I bought a set. I didn’t have problems with sticking but they sure got scratched up fast which the ad also claims won’t happen no matter utensils are used

  3. John Smizer says:

I bought the the 2 pans for one price about a year ago. They worked great until I made pancakes, the pan stuck so badI could not get the pancake off the pan. The other pan started sticking with bacon. I hate these pans

  4. Donna Merza says:

My husband bought me a set last year from Costco. Did not use the bigger pan until small pan started to stick even with butter or oil. Now just waiting for the bigger pan to start sticking to throw away in trash.

  5. Bill Tiedemann says:

Bought the Gotham Steel Hammered Pan online after seeing numerous promos for the pan. Bought it on 4/3/2020. After using it for 2 or 3 months it starting sticking. We only cook eggs in the pan and only use non-metallic utensils and sticking scrambled eggs is no fun to clean if you don’t want to scratch the surface. Disappointed. We bought a couple Green Pans a couple months before this one and they still do not have the sticking issue.

  6. Ryan Bliss says:

We have bought hundreds of dollars worth of these expensive Gotham non-stick pans and most of them began to show scratches within the first couple of uses, even without using metal utensils. False advertising is an understatement – this is straight up highway robbery. Everything sticks to our pans. It’s ridiculous.

    1. Holly Williams says:

I find this very strange as we only use plastic utensils on them & no scratches.
It also depends on how you are storing them.

  7. Donna Speckman says:

I bought a Gotham two-pan set at Costco about a year or so ago, and my omelets have been sticking so bad to these pans recently, even with oil and butter, that I decided to go online to see if there was something I could do to remedy the situation. That online search brought me immediately to this page, so I see that I am not alone in my experience. Yet I still see ads for these pans routinely on television, with the product being touted as miraculously non-stick. Definitely false advertising. These pans were pricey, even at Costco, and they are performing far more poorly than my very old non-stick pans.

  8. Babe says:

I bought my set off of Groupon and initially it did not stick but after just a few months it was sticking. My stock pot has oxidation going on and you can see the aluminum base. Disappointed really wanted these to be different.

  9. Tim Hein says:

I bought a whole set. Even some of the finish is coming off the pots. 2 frying pans everything sticks and 3 pots 1 large 2 smaller. Finish in the big pot is starting to come off in little spots. Don’t use them much anymore. Had them about a year. The worst non-stick pots and pans I’ve ever purchased!!!

  10. Gord Andrews says:

I bought this pan from watching the tv ads and tv cooking demos , but after a month or two everything sticks like crazy glue on your fingers, it’s useless ,no matter what oil or butter I use everything sticks. It s totally useless,I will never purchase. I’m in Canada and hopefully if there is a settlement,I’ll at least get my expense returned to me, I bought this at a Walmart store ,but no longer have the receipt,
