Champion Toilet Class Action Lawsuit Overview:

  • Who: Plaintiff Robert Weiss lodged a class action lawsuit against American Standard Brands.
  • Why: Weiss alleges American Standard sold Champion brand toilets with defective parts, causing water waste.
  • Where: The class action lawsuit was filed in California federal court. 

American Standard Brands manufactured and sold its Champion brand toilets with defective gasket and/or flush valves, a new class action lawsuit alleges. 

Lead plaintiff Robert Weiss claims the defect causes premature failure which leads to water waste and makes the toilet require frequent repairs and monitoring. Weiss wants to represent a nationwide Class of consumers who purchased the defective Champion toilets. 

Defective Champion Toilet May Flush Golf Balls, But Also Leaks

The plaintiff alleges American Standard Brand engaged in misleading consumers by advertising that the Champion toilet can “flush a bucket of golf balls without issue while maintaining minimal water consumption.” 

Weiss says he was impressed after seeing the golf ball demonstration on YouTube and ended up buying three American Standard Brand Champion 4 toilets for his house. 

“These representations are intended to convince consumers that despite the Class Product’s minimal water usage, the toilet is capable of performing well in excess of that which a toilet would need to flush,” states the class action lawsuit. 

Weiss alleges the toilet uses more water than what the advertising represents and also fails to deliver on the flushing performance it promises.

The plaintiff says that he and other owners of the Champion toilet are unaware the valve is defective until they receive an unusually expensive water bill.

Champion Toilet Defect

The purpose of the flush valve in question is to keep water from draining out of the holding tank until the toilet is flushed. A defective valve will lead to leaking and periodically cause the toilet to flush on its own, wasting more water, the class action lawsuit says. 

Weiss alleges the toilet caused him to incur damages including but not limited to repair and replacement costs, increased water bills, a diminution in value to the toilet, and overpayment at the original time of purchase. 

American Standard Brand is aware of the defect but has failed to change the design or solve the problem, according to the class action lawsuit. 

The plaintiff alleges that American Standard violated California’s Consumers Legal Remedies Act, false advertising, and unfair competition laws. 

Weiss is requesting a jury trial where he is seeking damages, restitution, and/or disgorgement for himself and other members of the Class. Plaintiff also wants the defendant to be barred from further engaging in its alleged unlawful and unfair business practices.

American Standard Brand agreed to pay class action rebates of more than $800 to end a lawsuit accusing the company of selling air conditioners and heat pumps with defective parts. 

A similar class action lawsuit was also filed against Fluidmaster in 2017 that alleged the company sold toilets with defective hose components

    I have a champion toliet that we purchased in 2019 after viewing the claims of the reliability of the toliet. Unfortunately I have had top replace t]parts on multiple occasions. When I called the consumer line today, the customer service rep stated “that you would have replace certain parts yearly”. Yearly I said are you nuts. I have to have a plumber come out and pay him. She said that there are many how to videos so that I do not have to hire someone I can do it myself. My water bills have been outrageous. Now I have to monitor [parts yearly. I want them to compensate me and I will buy a different brand of toliet.

    In \addition the rep said maybe your plumber isnt knowledgeable of our toliets. My plumber has been working for 32 years with a successful company.

    My water bill is high ghost flushing. Need to replace torliet. How do I join? I have 4 champion toliets.

    I too have a American Standard 4021N Toilet with ghost flushing. After i got my bill which was extremely high I thought it was the pool but listening and opening the tank to the toilet the water is draining down and the fill valve keeps going on to fill the tank water is filling the bowl and draining down that filling back up. I replaced the fill valve and its still draining down. Now repalcing the flapper components. My water bill is over $400.00

    I have same problem x2. I replaced flush valve seal same problem occured (No Joy). After months of searching I finally found one of my receipts. My water bill has gone up. I know it is probably for my septic system. So disgusted

    My champion American Standard is costly to say the least. Now Home Depot is saying that they won’t refund me anything. Please message me with any class action suits that I could join to recover my loss.

      I have 2 American Standard 4149A toilets that started leaking at the same time, 7 years after installation. Warranty is only 5 years and the special flush valve is much more expensive than a normal “flapper” valve.

    I purchased 3 American Standard Champion toilets in April 2024, and since then, my water bills have been unusually high. They started around $230/month, but this month it spiked to $404 for 56 days. I discovered all 3 toilets were ghost flushing every few minutes, causing constant leaks. I didn’t expect this issue with new toilets. After replacing the flush valves this week, the ghost flushing and leaks stopped. This has caused a lot of financial strain and stress. Very disappointed with the product quality. how do i join to this lawsuit?
