Bob’s Discount Furniture Goof Proof class action overview: 

  • Who: A Bob’s Discount Furniture customers is suing the company over its Goof Proof insurance policy
  • Why: The customer says Bob’s does not pay out insurance on its furniture when it should
  • Where: California federal court

Bob’s Discount Furniture often denies insurance claims for its Goof Proof insurance, even when the damage is clearly covered under the policy, a new class action lawsuit alleges. 

Plaintiff Kenneth Wong filed the class action lawsuit against Bob’s Discount Furniture LLC June 20 in a California federal court, alleging violations of state and federal consumer laws. 

He said the company sells furniture with added protection plans known as “Goof Proof” which is marketed as “the best way to protect your investment from a wide variety of accidents for 5 years.”

However, he alleges the company’s sale of discount furniture with added coverage only for accidental damage falls outside of a typical insurance service contract.

“Defendant denies claims based on customer misuse, even where that misuse may have occurred unintentionally, and is unexpected or unforeseen, which is the definition of an accident,” Wong says.

“In reality, Goof Proof does not protect the furniture purchased by Bob’s customers.”

Sofa and chair not covered under insurance

In Wong’s case, he bought a Jaxon sofa/chair combo for $749.00, and Goof Proof for $129.99, at Bob’s Discount Furniture in 2019.

In June 2020, Wong submitted claims for his sofa and chair, because the chair arm became deformed.

Bob’s Discount Furniture denied his claim, saying the damage didn’t happen accidentally, but rather through normal use. 

“Defendant’s denial of the claim on the chair’s arm because it was ‘not classified as

a customer-caused accident’ even though it ‘occurred from a single incident’ ‘during normal use of the item’ disregards that the breakage occurred due to the underlying faulty frame of the chair,” the lawsuit states. 

“To the extent coverage was denied based on damage occurring during ‘normal use’ of the chair, this is equivalent to a wear and tear exclusion.”

Wong is suing on behalf of all California customers who purchased Goof Proof.

He’s suing for breach of warranty, breach of California consumer laws, and for bad faith insurance denial. Wong is seeking certification of the class action, damages, an injunction, fees, costs and a jury trial. 

This is not the first class action lawsuit over this issue. In April, Bob’s Discount Furniture was hit with a class action lawsuit alleging it misled consumers about the quality of a couch with a reclining chair it sold and then failed to honor extended warranty claims when it prematurely broke.

    How do you join the lawsuit against Bobs Discount Furniture? The sectional reclining sofa I purchased is garbage and they aren’t covering anything. The fabric, the power recliners, nothing! It’s less than a year old.

    I’m in California and would like to submit a claim! I bought a sectional and the back of the cushion was broken because it had a dried out cheap piece of wood and is supposed to be the support of the back rest snapped in half and is now poking through the back of the sofa ripping it. It also causes the cushion to sink in. I also had this experience with a brand new bed on the first day. Their furniture is just super cheap.

    I bought a sectional couch from Bobs discount furniture. The sales man we bought it from also talked us into purchasing the Goof protection. All the back cushions have sunk in and have major gaps in-between them, We still owe around $1000 on this purchase. I told the salesman that I was afraid that the cushions would do this, as I have seen other couches sink in the same manor. The salesman , said if that happens, with the goof proof guarantee, they will replace at no cost. I submitted my claim with pictures, and the claim was denied by the Goof Proof. plan. I also can not put the lounge part of the sectional together with the couch part. I feel I was lied to and misled by the sales rep. at Bobs discount furniture. is there any where for me to turn? I would appreciate any feedback. Thank you!

    Hello, my name is John and I bought furniture from Bob’s furniture and at the same problems. A lot of the other customers had my furniture broke within two months of having it and I contacted the insurance company and they would not fix it. I had the manager at Bob’s furniture in Whitemarsh, help me and they still didn’t fix it. I won my case against them now I’m waiting on them to send me a check. My couch is a piece of junk and I need a new couch ASAP and I know they’re going to take their time sending me my check and I need a couch now please help.

    How can I be a part of this claim against Bob’s Furniture. I was denied refund or exchange on new furniture that the driver dropped before he even bought it inside my home which is damaged the frame on sofa. I called immediately with the driver still there , explain to them what happened and they still did not want to give me my money back nor give me a new sofa.

    In November 2022 my daughter and I bought a sectional, power recliner, trundle bed, and ottoman. Within a few months the frame of the bed broke. They did replace the parts that time because it was less than one year old. Fast forward to summer 2024. My daughter sat on the ottoman to put her shoes on and the frame broke. There’s exposed wood and nails on a section of the couch and the cushion has ripped off the back of the frame. After submitting claims and pictures it was initially approved. A technician came out to examine the couch and submitted pictures along with his claim that it needed a new back and several other details. Guardian, who handles Bob’s prior to plan than denied all claims. I submitted a second claim on the trundle bed and am waiting for a decision. The salesman promised us that with the Goof Proof Protection Plan that occidental wear and damage would be covered for 5 years. I’ll never purchase another thing from Bob’s. We work hard for our money and not being able to get it repaired is ridiculous.

    Is there a NJ class action lawsuit against Bob’s Furniture (Warranty)… I’d like to be added to the list!

    I purchased a dining room set and warranty in case of damages. Only after a few months, noticed that 2 of the chairs started sinking. Took pics and submitted it along with a claim. They asked for more details about how damage occurred. Responded that nothing was done, that after a few months of daily sitting, it just sinks now. One of the chairs has essentially a hole. They responded back that unfortunately they warranty only covers accidents, not damage due to wear and tear. But I find that to be BS, as if this only happened from a few months of usage, it obviously isn’t wear and tear, but instead a manufacturer defect. I’m livid that I paid for warranty and they are essentially doing everything not to fix. I have also recently been told second-hand from an ex-employee that they purposely find ways to evade paying. I’m frustrated and want my money back.

      Hello I was also denied for my claim since apparently a recliner breaking within 2 years is not covered. If there is a way to join the class action suit please sign me up.
