UPDATE:

  • The AmeriGas pre-filled propane tanks class action settlement was granted final approval March 30, 2021.
  • Let Top Class Actions know when you receive a check in the comments section below or on our Facebook page.

Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing.

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

    3. Ron says:

      Don’t sweat it..$3.47
This was so full of crap because I filled out the form that I had 22 tanks in the years time period.
It also said this was a second dispersement of what was left in the funds.
Pretty convenient for them to start sending checks in a pandemic.

  2. Brenda says:

Sounds like a joke just to get something fix you have to call five days and then they hang up on you. It’s ridiculous. I think the company stinks in for the money it always goes in the attorneys pocket you get nothing. Once they have a lawsuit everybody that has the propane they should be awarded it and they should have the list of all the people but I bet you that list became one or two names and it’s the attorneys names not the clients.

  3. Cathy Buckmeier says:

In July 2021 I emailed them my new address. They sent me a confirmation email. I sent another email claiming that I’m still waiting for my check. They replied with sorry it’s too late. Class action is closed. From all the other comments, I’ve concluded that they line their pockets with money that they never planned on sending. I’ve decided this is all a scam.

    1. Sherri says:

They said they sent me a check I never received so it took months to get a second one and the name was all wrong there’s no way it could have been mine so I emailed them again with a picture of the check well I was just informed on the 8th that a check was sent out on the 7th we’ll see. The funny part is when I called to see if they had the right address in the first place because I had moved they said they couldn’t even find my claim LOL these people are something else…

    2. Guillermo A Narro says:

I’m starting to believe this is a scam because I filled my form on time for 3 different class action and have not received anything from them.
