A settlement of up to $2 billion has been reached in litigation against Monsanto’s Roundup Weedkiller.
Roundup’s producer, Monsanto and its parent company, Bayer, have faced a wide range of lawsuits from farmworkers and home gardeners alleging that they were diagnosed with cancer after using Roundup weedkiller.
Last June, Bayer announced preliminary settlements to resolve the outstanding litigation, according to a Bayer release.
At the time, Bayer expected up to $9.6 billion would need to be spent to cover claims.
The judge on the case ruled the court was skeptical about the fairness of Bayer’s proposal last year.
This latest settlement deal, filed Wednesday, has been rebuilt to avoid the “pitfalls” of the initial one, according to the filing.
Bayer said Wednesday the deal can include consumers who have not filed yet.
“The Settlement does so on terms whereby not a single class member can lose the right to sue Monsanto for compensation,” the motion for approval stated.
This latest proposed settlement emphasizes how it is only being offered to qualifying class members. Those who reject compensation may return to court for other remedies.
“Class members do not lose their right to sue Monsanto for compensatory damages unless and until they make an individual, affirmative choice to give up such rights,” the proposed settlement stated.
Several other key elements of the settlement, according to the motion:
- Compensation fund for additional claims
- Legal assistance at no cost to help with evaluating and filing claims
- Diagnosing and testing grants
- Media outreach to potential class members
- Change in labeling
- Funding research for treatments relating to exposure
Roundup was introduced to consumers in the 1970s by Monsanto. Its use has since grown to be used in more than 160 nations at a rate of some 1.4 billion pounds a year.
Its active ingredient, glyphosate, was declared a carcinogen by the International Agency for Research on Cancer in 2015.
Roundup’s toxicity made headlines in 2018 when a California groundskeeper Dewayne Johnson was awarded a $78 million settlement in a lawsuit claiming the weedkiller gave him non-Hodgkin’s lymphoma, NPR reports.
At least 42,700 plaintiffs had formed legal actions by 2019 against Bayer, Bloomberg reports, following Johnson’s case. Top Class Action is offering case evaluations for those who have used Roundup weedkiller. Read more to see if you qualify.
