Trader Joe’s represents its name brand Honey Graham Crackers as made with whole grain when they actually predominantly contain white flour, a new class action lawsuit alleges.
Plaintiff Heather Swanberg claims Trader Joe’s misrepresents the product by making the whole-grain ingredient “Graham” the largest on its label.
“Reasonable consumers expect a food identified by the name of a whole grain flour will contain mainly whole grain flour and more whole grain flour than if the food was merely labeled, “Crackers,’” the class action lawsuit states.
Swanberg claims consumers are drawn to whole grain food items because they are known to contain more fiber than ones made with white or enriched flour.
The nutrition facts on the Honey Graham Crackers packaging indicate it is not a good source of fiber per serving, according to the class action lawsuit.
“Plaintiff and consumers expect a product represented with such “whole grain” claims to be a good source of fiber, defined (as) providing at least 10 percent of what adults should consume each day,” states the class action lawsuit.
Trader Joe’s Intentionally Misleads Customers To Gain Competitive Advantage, Plaintiff Claims
Further, Trader Joe’s intentionally misleads consumers about the whole grain contents in its crackers in order to gain an advantage over its competitors, the class action lawsuit alleges.
Swanberg claims Trader Joe’s violated the Illinois Consumer Fraud and Deceptive Business Practices Act and multiple state consumer fraud acts.
She is demanding a jury trial and requesting injunctive relief along with monetary, statutory and/or punitive damages for herself and all class members.
Swanberg wants to represent an Illinois class and multistate subclasses of consumers who purchased the Trader Joe’s brand Honey Graham Crackers.
Trader Joe’s recalled almost 100,000 pounds of its chile lime chicken burgers and unbranded spinach feta chicken sliders last month over concerns of bone fragment contamination.
