Snyder’s-Lance Whole Grain Class Action Lawsuit Overview:

Snyder’s-Lance misleads consumers about the significance of the amount of whole grain in its peanut butter sandwich crackers, a new class action lawsuit alleges. 

Plaintiff Joseph Vazquez claims Snyder’s-Lance fails to disclose on the front packaging the amount of refined grains compared to the amount of whole grains. 

Vazquez claims Snyder’s-Lance peanut butter sandwich crackers prominently display that they contain 11 grams of whole grain to entice customers who are looking to have more whole grains in their diet. 

“However, because the Product contains only a miniscule amount more of whole grain than refined grain, they will not successfully make up that deficit by consuming the Product,” the class action lawsuit states. 

Vazquez argues consumers will ultimately end up unintentionally consuming an “excess” amount of refined grains. 

FDA Recommends Products With Whole Grain Claims Not Contain Non-Whole Grains, According To Class Action 

The U.S. Food and Drug Administration (FDA) has warned companies against being misleading about the amount of whole grains their products contain, according to the class action lawsuit. 

“The recommendation of the FDA was that products labeled with unqualified whole grain claims or 100% whole grain claims not contain non-whole grains,” the class action lawsuit states . 

Vazquez claims Snyder’s-Lance has been able to sell more of its whole grain peanut butter sandwich crackers due to its “misleading” representations. 

“The value of the Product that Plaintiff purchased was materially less than its value as represented by defendant,” the lawsuit states.

Vazquez claims Snyder’s-Lance is guilty of negligent misrepresentation, fraud, unjust enrichment and breach of express warranty and in violation of multiple state consumer fraud acts and the Magnuson Moss Warranty Act.

Vazquez wants to represent a New York class of consumers and multistate subclass of individuals who purchased Lance brand whole grain peanut butter sandwich crackers. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with monetary, statutory and/or punitive damages for himself and all class members. 

A similar class action lawsuit was filed last year against Trader Joe’s by a consumer claiming the company falsely represents that its Honey Graham Crackers are primarily made with whole grain flour
