Sara Lee agreed to a $1 million settlement to resolve class action lawsuit claims its pound cake products are made with “all butter” despite containing other shortening ingredients. Consumers do not need proof of purchase to make a claim.

The settlement benefits consumers who purchased Sara Lee All Butter Pound Cake products between April 27, 2017, and July 29, 2022.

Sara Lee offers numerous desert products such as pound cakes, cheesecakes, pies and sweet breakfast pastries. One of the brand’s most popular products is its pound cake. 

According to a class action lawsuit against the company, Sara Lee’s pound cakes are misleadingly marketed as “All Butter” pound cakes. In reality, the products allegedly contain other shortening ingredients such as soybean oil.

Consumers say they were misled by Sara Lee’s “All Butter” marketing and were tricked into paying more based on the belief that the pound cake products were made with only butter. If they knew the truth, plaintiffs and other consumers allegedly would have paid much less for the pound cakes or wouldn’t have purchased the products at all.

The class action lawsuit includes claims under Illinois consumer protection and false advertising laws.

Sara Lee has faced more than one class action lawsuit over its pound cake. 

Consumers filed similar allegations in Illinois federal court. This class action lawsuit also challenged Sara Lee’s use of yellow food dye, arguing that this additive aimed to make the pound cake look more buttery. The case was dismissed in April 2021. 

Sara Lee hasn’t admitted any wrongdoing but agreed to resolve the current false advertising allegations with a $1 million class action settlement.

Under the terms of the Sara Lee settlement, class members can receive a cash payment based on the number of products they purchased. 

Class members can get $1 per product. Without proof of purchase, class members can claim up to five products for a maximum payment of $5. With proof of purchase, class members can claim up to 20 products for a maximum payment of $20 per household. 

The minimum payment for any valid claim, regardless of proof of purchase, will be $3.

The settlement also includes a permanent injunction prohibiting Sara Lee from using “All Butter Pound Cake” marketing claims. Instead, the products at issue will be described as “Classic Pound Cake.”

The deadline for exclusion and objection Oct. 11, 2022. 

The final approval hearing for the Sara Lee settlement is scheduled for Oct. 20, 2022.

In order to receive settlement benefits, class members must submit a valid claim form by Oct. 11, 2022.

Who’s Eligible

The settlement benefits consumers who purchased Sara Lee All Butter Pound Cake products between April 27, 2017, and July 29, 2022.

$1 per product

Proof of Purchase

Proof of purchase not applicable, class members that do provide proof of purchase can potentially receive a higher payout
