Popcorn Indiana class action lawsuit overview:ย 

  • Who: Melissa Gibson filed a class action lawsuit against Eagle Family Foods Group LLC.ย 
  • Why: Gibson claims Eagle Family Foods misleadingly represents that its Popcorn Indiana brand popcorn products are made in Indiana.ย

Eagle Family Foods Group misleadingly represents that its Popcorn Indiana brand popcorn products are made in Indiana, a new class action lawsuit alleges.ย 

Plaintiff Melissa Gibson claims the Popcorn Indiana popcorn products are actually manufactured in Waukegan, Illinois, and have โ€œno real connectionโ€ to the unincorporated community of Popcorn, Indiana, or Indiana in general.ย 

Gibson argues Eagle Family Foods fails to disclose on either the front or back of its packaging for Popcorn Indiana popcorn products that they are not made in Indiana.ย 

โ€œConsumers expect Popcorn Indiana to be made in Indiana from start to finish and contain the unique characteristics of popcorn made there,โ€ the Popcorn Indiana class action states.ย 

Consumers willing to pay โ€˜premium priceโ€™ for โ€˜authenticโ€™ products, Popcorn Indiana class action states

Gibson claims consumers are willing to pay a premium price to purchase a product that they believe is authentic due to it being linked to a specific place, โ€œsuch as popcorn grown and popped in Indiana.โ€

โ€œTodayโ€™s consumers are faced with increasing commercialization of products and seek brands that are genuine โ€“ whisky from Scotland, sake from Japan and tomatoes from Italy,โ€ the Popcorn Indiana class action states.ย 

Eagle Family Foods is accused of fraud, unjust enrichment, and negligent misrepresentation, and of violating multiple state consumer fraud acts, the Magnuson Moss Warranty Act, and the Indiana Deceptive Consumer Sales Act.ย 

Gibson demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for herself and all class members.ย 

She wants to represent an Indiana class and multistate consumer fraud class of individuals who have purchased a Popcorn Indiana popcorn product.ย 

In related popcorn news, A consumer filed a separate class action lawsuit against Conagra Brands last month, arguing the company falsely advertises that its Orville Redenbacher Naturals brand popcorn contains only natural ingredients.ย
