Altoids cinnamon mint class action lawsuit overview: 

  • Who: Brent Scruggs filed a class action lawsuit against Mars, Incorporated.
  • Why: Scruggs claims Mars misleads consumers by falsely advertising that its Altoids Cinnamon Mint product contains cinnamon. 
  • Where: The class action lawsuit was filed in California federal court. 

Mars misleads consumers by falsely advertising that its Altoids Cinnamon Mint product contains cinnamon, a new class action lawsuit alleges. 

Plaintiff Brent Scruggs claims Mars’ Altoids Cinnamon Mint product “prominently depicts an image of cinnamon sticks” and displays the word “CINNAMON” in large bold font despite it not containing any cinnamon. 

Scruggs argues consumers like himself would not have purchased the product or paid less for it had they known it did not actually contain cinnamon. 

“Unfortunately for consumers, Defendant engages in false and misleading advertising about the Product to gain a competitive edge in the market, all at the expense of unsuspecting consumers,” the Altoids class action states. 

Reasonable consumers, Scruggs argues, are led to believe the Altoids Cinnamon Mint product contains cinnamon due to the visual and text representations on its packaging. 

Altoids class action claims Mars ‘grossly misled’ consumers with cinnamon representations

Scruggs argues these reasonable consumers are thus being “grossly misled” by Mars’ alleged misrepresentations that the product contains cinnamon. 

Mars’ alleged misrepresentations also violated regulations set by the U.S. Food and Drug Administration (FDA) requiring manufacturers “to label their products in a specific manner to avoid consumer deception,” the Altoids class action alleges. 

“Defendant’s violation of FDA regulations further supports Plaintiff’s allegations that reasonable consumers have been misled,” the class action states. 

Scruggs claims Mars is guilty of unjust enrichment and breach of implied and express warranty and in violation of California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law

He demands a jury trial and requests declaratory and injunctive relief along with an award of economic, monetary, actual, consequential, compensatory and treble damages for himself and all class members. 

Scruggs wants to represent a California class and California consumer subclass of individuals who have purchased Mars’ Altoids Cinnamon Mint Product. 

A separate class action lawsuit was filed against Mars last month over claims the company continues to sell its Skittles product despite allegedly knowing the candy contains titanium dioxide, a toxin known to be unsafe for human consumption.

    I have used cinnamon altoids for years i didnt know they had no cinnamon nor did i know ithey had toxic chemicals in them i sure am very much upset about just learning this could be why im having medical problems

      I didn’t see anything about toxic chemicals in Altoids. The article mentions a Skittles lawsuit due to Titanium dioxide.
