Sony class action lawsuit overview:

  • Who: Plaintiff Joseph Musharbash filed a class action lawsuit against Sony Electronics Inc.
  • Why: Musharbash claims the serial number on his top-of-the-line G Master Sony lens fell off, preventing him from getting free repairs under a recall.
  • Where: The Sony class action lawsuit was filed in California federal court.

Sony Electronics Inc. faces a class action lawsuit alleging the serial number stickers affixed to some of its lenses fall off, leaving consumers unable to determine whether their Sony lens is affected by a recall.

Plaintiff Joseph Musharbash says he purchased a top-of-the-line G Master Sony lens because he believed it would be free of defects or, if it was defective, Sony would be able to identify the product and fix the issue.

The G Master lens is designed to satisfy professional requirements and is more resistant to dust and water than other professional-quality lenses, the class action lawsuit alleges. The prices for the G Master lenses reportedly range from $1,500 to $2,800.

Sony recalled the SEL1635GM F2.8 lens because, when attached to a camera, it could cause the camera to not operate correctly. Sony directed customers who purchased a recalled Sony lens to enter the serial number on its website and, if it was affected by the recall, Sony would repair the lens free of charge.

Sony class action says serial number falls off, preventing lens from recall acceptance

Musharbash says he experienced display issues with the rear screen of his camera due to a problem with the Sony lens. When he contacted Sony customer support about the issue, they reportedly said his experience was consistent with the G Master lens recall.

When the customer service representative asked Musharbash for the serial number on his lens, he discovered it was not affixed or otherwise printed on the lens, according to the class action lawsuit.

Musharbash says Sony informed him his lens would not be accepted under the recall because it did not have a verified serial number. He says he did not expect the serial number would not be permanently affixed to the product, resulting in him being unable to obtain post-sale servicing.

The Sony class action lawsuit asserts claims for violation of California’s Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act, as well as breach of warranty and unjust enrichment.

Musharbash filed the Sony class action lawsuit on behalf of himself and a proposed class of U.S. consumers who purchased the G Master lens.

Earlier this year, a California federal judge dismissed a Sony class action lawsuit over an alleged monopoly of the sale of digital PlayStation games.
