Apple has agreed to pay $9.75 million to resolve claims that Powerbeats2 battery life is poor, devaluing the wireless earphones.
The Powerbeats2 battery life class action settlement benefits individuals who purchased Powerbeats2 earphones before Aug. 7, 2020. Settlement Class Members must have purchased the products for personal use, not for resale.
Plaintiffs in the Powerbeats2 wireless earphones class action lawsuit claimed that Apple misrepresented the devices and concealed the fact that the earphones came with a serious defect. Allegedly, the defect causes the wireless earphones to fail to retain a charge – leading to poor Powerbeats2 battery life. Eventually, the earphones allegedly cease working entirely.
To make matters worse, Apple reportedly failed to properly repair or replace defective Powerbeats2 while the earphones were under warranty.
Consumers claim that Powerbeats2 battery life and other features such as sweat and water resistance did not live up to Apple’s representations. If purchasers had known the truth about Powerbeats2 wireless earphones, they allegedly would not have purchased the items or would have paid significantly less for them.
Apple has not admitted any wrongdoing but has agreed to resolve the claims against them with a $9.75 million Powerbeats2 battery life class action settlement.
Under the terms of the Powerbeats2 battery life settlement, Class Members can collect cash payments of up to $189. Exact payments amount will depend on whether or not Class Members received a warranty repair or replacement and if they can provide proof of purchase.
Class Members will receive payments dependent on their “points” which are assigned based on the number of warranty repairs or replacements, if they provide proof of purchase, and how many proofs of purchase they provide. More information about points criteria is available in the “Potential Award” section below.
If 150,000 total points are claimed by all Class Members, claimants will receive around $40.10 per point. If there are 300,000 points claimed, claimants will receive around $20.04 per point.
In order to benefit from the Powerbeats2 battery life class action settlement, Class Members must file a valid claim form by Nov. 20, 2020. Claim forms will require purchase information (dates, store name, city and state, etc.). Proof of purchase isn’t required but will allow for higher payments.
The deadline for exclusion and objection is Nov. 20, 2020. The final approval hearing for the Powerbeats2 battery life class action settlement is Jan. 21, 2021.
Who’s Eligible
Individuals who purchased Powerbeats2 earphones before Aug. 7, 2020. Settlement Class Members must have purchased the products for personal use, not for resale.
Potential Award
Cash payments of up to $189.
Exact payment amounts will depend on whether or not Class Members received a warranty repair or replacement and if they can provide proof of purchase. Class Members will be assigned points based on the following criteria:
- No proof of purchase and no record of warranty repair or replacement: 1 point
- No proof of purchase and record of one warranty repair or replacement: 2 points
- One valid proof of purchase and no record of warranty repair or replacement: 2 points
- One valid proof of purchase and record of one warranty repair or replacement: 2 points
- Two valid proofs of purchase and no record of warranty repair or replacement: 4 points
- One valid proof of purchase and record of three successive warranty repairs or replacements: 6 points
