A class action lawsuit accuses Apple and Samsung of marketing and selling phones that emit radiofrequency radiation above legal and safe levels. This is not the first class action lawsuit that the companies have faced over this issue.
The Apple and Samsung radiofrequency class action lawsuit was filed by numerous customers — including Paul Coletti, Krystle Faeryn, Rodolfo Cabrera, Brandy Davis, and others.
The customers claim that Apple and Samsung advertise that their phones can be carried and used close to one’s body for a long period of time.
To support this claim, the customers note that the companies market their phones with phrases such as “your life in your pocket,” “the Internet in your pocket,” or a “studio in your pocket.”
Additionally, the companies allegedly advertise the phones being used in many contexts close to one’s body, including in bed, and for use on skin in sonograms.
The cell phone radiofrequency class action lawsuit says that despite these advertisements, research suggests that they are not safe for this use.
Allegedly, recent testing suggest that radiofrequency radiant exposure can have a negative effect on living creatures, even if the levels of exposure are far below legal levels.
Risks reportedly associated with exposure can include a range of serious issues, including “increased cancer risk, cellular stress, increase in harmful free radicals, genetic damage, structural and functional changes of the reproductive system, learning and memory deficits, neurological disorders, and negative impacts on general well-being in humans.”
The customers go on to say that cell phones use radiofrequency radiation to send signals, and note that it is called non-ionizing radiation. Though this type of radiation allegedly emits less energy than ionizing radiation, it has allegedly still been classified as a “possible human carcinogen.”
The cell phone radiation class action lawsuit says that because of this risks, governments around the world have put caps on the amount of energy that can be emitted by cell phones.
The Apple iPhone class action lawsuit goes on to say that when cell phones are used for a long period of time, in close proximity to a person’s body, the user is exposed to around four times the legal amount of radiation.
Allegedly, the companies knew that it was not safe for customers to use the phones close to their body — they note that Apple included a warning for customers to use their smart phones at a certain distance away from their body, but dropped the warning in later models.
The Samsung class action states that the companies intentionally misled customers into believing that the devices were safe to use for a long time, close to the body.
The customers claim that they were injured by the devices because their health was put at risk. They say that had they known that the cell phones emitted a dangerous level of radiofrequency, they would not have purchased them at all or would not have paid as much for them.
