Puff Bar nicotine class action lawsuit overview: 

  • Who: Plaintiff Hayley Amiel filed a class action lawsuit against EVO Brands LLC and PVG2 LLC, both doing business as Puff Bar.

The makers of Puff Bar nicotine products mislead consumers about the nature and safety of them, a new class action lawsuit alleges. 

Plaintiff Hayley Amiel’s class action lawsuit claims EVO Brands LLC and PVG2 LLC market their Puff Bar nicotine products to young people, thereby misleading them about the fact it is illegal to sell them to anyone under the age of 21. 

“Defendants market and have sold, and allow resellers to advertise and sell, Puff Bar nicotine products when these products are illegal, which is misleading and unfair to consumers,” the Puff Bar class action says. 

Amiel wants to represent a nationwide class and New York subclass of consumers who bought Puff Bar nicotine products during the applicable statute of limitations period. 

Puff Bar misled consumers about ‘addictive nature’ of products, class action claims

Amiel argues Puff Bar also deceives consumers by labeling the electronic cigarette products with “5%” nicotine, misleading them into thinking the “addictive nature” of the products is lower than it allegedly is. 

Further, Amiel claims Puff Bar nicotine products are labeled as “tobacco-free,” which she says leads consumers to believe they “do not have the safety risks associated with tobacco or tobacco-derived nicotine products.” 

“Defendants market and advertise their Products as ‘tobacco-free,’ which misleads consumers to think that the Products are safer than they are,” the Puff Bar class action argues. 

Amiel claims the Puff Bar makers breached the implied warranty of merchantability and violated New York General Business Law and U.S. state consumer protection statutes. 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory, compensatory and punitive damages for herself and all class members. 

A consumer filed a class action lawsuit against Puff Bar in 2021 over claims its Pull Plus vape pens were falsely advertised as able to last for 800 puffs.
