Ebay is accused of selling illegal items that range from emission control devices to pesticides that break standards set by the U.S. Environmental Protection Agency (EPA), according to a new lawsuit filed by the U.S. Department of Justice (DOJ) in New York federal court.
The company is accused of selling products that violate the Clean Air Act (CAA), Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Toxic Substances Control Act (TSCA), the eBay illegal sales lawsuit says.
“Ebay’s sale of emission control defeat devices, pesticides, and other unsafe products poses unacceptable risks to our communities disproportionately impacted by environmental and health hazards,” United States Attorney Breon Peace said in a statement. “Together with our partners, this Office will vigorously enforce federal law against those whose conduct endangers public health and the environment.”
The eBay lawsuit asks the court to order an injunction stopping eBay from violating the federal rules and to assess civil penalties for the Clean Air Act violations.
Ebay sold more than 343K aftermarket vehicle emission control defeat devices, lawsuit says
Ebay is accused of selling, offering for sale or causing the sale of more than 343,000 aftermarket automobile parts that defeat motor vehicle emission controls, a violation of the Clean Air Act.
Those parts cause vehicles to emit hundreds to thousands of times more pollution that includes nitrogen oxides, carbon monoxide, non-methane hydrocarbons and particulate matter, according to the EPA.
An eBay settlement of a class action lawsuit on its “Buy It Now” option was settled in 2015, awarding payment to some who paid for at least one “Buy It Now” listing between July 30, 2008, and Sept. 10, 2015, you may be eligible for payment from the eBay class action settlement.
