iPhone update screenA $500 million settlement has been reached between Apple and customers to resolve a multidistrict litigation claiming that the tech giant intentionally released iPhone updates that would slow older phone models and eventually require the users to buy new phones.

Of the $500 million, attorneys for the customers have requested as much as $93 million in fees and $1.5 million in expenses.

Class Members will receive $25 each for their phones if the payments total $310 million. If the total payments made do not add up to $310 million, the settlement terms dictate that Class Members will receive up to $500 each until the total reaches $310 million. Apple has agreed to pay no more than $500 million to compensate Class Members and attorneys. 

Class Members who may be eligible for compensation include all current or former U.S. owners of the iPhone 6, 6 Plus, 6s, 6s Plus, 7, 7 Plus, and SE smart phones, whose devices ran iOS 10.2.1 or later (for iPhone 6, 6 Plus, 6s, 6s Plus, and SE devices) or iOS 11.2 or later (for iPhone 7 and 7 Plus devices), and who ran these iOS versions before Dec. 21, 2017.

Now, the company and customers await preliminary approval for their settlement, the hearing for which is set for April 3, 2020. The settlement was reached with the help of retired Judge Layn R. Phillips of the U.S. District Court for the Western District of Oklahoma. 

Representatives for the iPhone owners spoke favorably of the settlement, calling the settlement “fair, reasonable, and adequate” to Class Members and arguing that it presents “substantial benefits.”

The iPhone MDL consolidated multiple class action lawsuits across the country. In these Apple iPhone class action lawsuits, customers claimed that the company intentionally created iPhone updates that would slow down older models of the phone and intentionally released them close to the release of a new iPhone model.

Allegedly, these updates could slow the functions of the older iPhones so much that customers could no longer use the phones. According to the iPhone class action lawsuits, many customers were effectively forced into purchasing a new phone because their older iPhone no longer worked.

The customers argued that Apple was unjustly enriched by this practice and claimed that the practice harmed consumers financially. The class action lawsuits were later combined into a multidistrict litigation. This iPhone MDL survived a dismissal bid by Apple, despite having some claims trimmed by a judge in the process.

    i have a I phone 7+ and it is the slowest ever just waiting for my contract to end to get a new phone so sad they do this after what we pay for their phones

    same problems with two iphone 6s. slowed way down . battery went obsolete paid 30 each for new batteries

    We have had a iphone ? 6+S since they were 1st released and it’s had nothing but issues with all of these updates, it keeps saying no service, no internet, won’t load anything not even Facebook.. And it’s a paid line through Sprint so it’s not a free phone ? but it’s complete garbage

    I bought 4 phone 2 6 and 2 6+ as they came out with more updates was told by apple I would have to buy new phones said they would not accept updates. Went with Samsung.

    I’ve bought my two daughters the iPhone 6 and bought myself the iPhone 6 then the next year upgraded to the 6plus for my 2 girls and my son then bought my daughter the 7 plus and they all started running slow. My oldest daughter kept telling me I’d have to upgrade because they would stop doing what their supposed to and she was right so I’ve bought 7 iPhones between 6-7 plus we bought 3 iPhone 5 and 3 iPhone 4.

    I brought my partner a iPhone 7 Plus, my daughter iPhone 6 Plus, and myself iPhone 7. All three phones had to get replaced with other phones due to how slow the phone got when newer iPhone models came out. I could use my internet at all.

    Please add me to lawsuit,,, I have purchased 6 iPhones now,,, 1 for myself and each of my two kids…. after time they slowed considerably and we were talked into buying newer version after a year or so,,,, they too had slowed considerably,,,, we are now on our third set as to switch phones, wed have to switch apps and lose a lot of our work,,,, please add us to your lawsuit,,,, thank you

    Bought my wife and I each an (1) apple iPhone 7 (2 iPhones total) they got slower abnormally as time went by and the release of the iPhone 8 grew closer. When we could no longer use these phones, and our business suffered, (And I could no longer count on it for use in health crisises as I had – my main reason I bought the advanced phone in the first place) we switched to Samsung Note8s. But, I almost died. Due to the averice Apple displayed in (allegedly) planned or forced damage to older models.
