A new class action lawsuit alleges the makers of Stirrings cocktail mixers misled consumers by advertising the mixers as preservative-free.
Plaintiff Teresa Rodriguez filed the class action complaint against Sazerac Company Inc. —- doing business as Stirrings — on Nov. 26 in a New York federal court, alleging violations of state and federal consumer laws.
Rodriguez alleges that the mixers, marketed with “No Preservatives” labels, actually contain the synthetic preservative citric acid, deceiving consumers into paying a premium for what they believe are healthier, preservative-free products.
The lawsuit centers on a wide range of Stirrings products, including its Margarita Mix, Old Fashioned Mix and Bloody Mary Mix.
According to the complaint, the “no peservatives” claim is not only false but strategically designed to appeal to health-conscious shoppers seeking additive-free options.
Rodriguez says she relied on the label when purchasing a mixer, believing the products were free of preservatives.
“Had [consumers] known the truth—that the representations they relied upon in making their purchases were false, misleading, and deceptive—they would not have purchased the Products at a premium price,” the Stirrings class action says.
Consumers lack knowledge to identify preservatives, lawsuit argues
Rodriguez also claims that consumers lack the specialized knowledge to identify citric acid as a preservative, placing full trust in the company’s labeling.
Conscious of the growing demand for products that appear healthier, the lawsuit claims Stirrings knowingly capitalized on consumer trends while violating the law.
As a result, Rodriguez is looking to represent anyone in the United States who bought one of the Stirrings mixers with “no preservatives.” She is suing for breach of warranty and state consumer laws, and seeks certification of the class action, damages, fees, costs and a jury trial.
Meanwhile, last month, Costco was hit with a class action lawsuit alleging it markets its Kirkland Signature Fish Oil supplements as supporting heart health while failing to disclose their potential risks.
