Kedem grape juice is not 100 percent “pure” as advertised, according to a recent class action lawsuit.
Kedem grape juice is sold in numerous stores around the country. The labeling for the juice product reportedly features a prominent “100% PURE” claim. This claim is reinforced with images of grapes on the packaging.
According to the Kedem juice class action, the 100 percent pure claim is further reinforced by video advertisements that show “grapes going directly from the vines into the bottles and using the slogan ‘Kedem, it’s about the Grapes.’”
Plaintiff Cynthia Weisberg argues that the company’s grape juice is not made from 100 percent grape juice and instead includes additional ingredients such as potassium metabisulfite – a synthetic preservative.
Weisberg states that it is reasonable to assume that the 100 percent pure claim means that the product contains only grape juice. “Pure” is defined by the Merriam-Webster dictionary as “unmixed with any other matter,” which the plaintiff claims can be interpreted as “containing a single, unadulterated ingredient.”
The Kedem class action further alleges that Weisberg and other consumers rely on representations that Kedem grape juice is 100 percent pure.
“Plaintiff and [Class Members] relied on Defendants’ misrepresentations that the Product is ‘Pure Grape Juice’ when purchasing it,” the Kedem class action lawsuit claims. “Plaintiff and Class Members paid a premium for the Product over and above comparable products that did not purport to be ‘Pure Grape Juice.’”
Because consumers rely on Kedem representations, they are allegedly willing to pay a higher price for the grape juice product. However, Weisberg argues that she and other consumers did not get their money’s worth when purchasing Kedem grape juice due to the fact that the product contains more than just grape juice.
The Kedem class action also claims that this deception is intentional. Weisberg says that Kedem grape juice manufacturers knew how their packaging would be interpreted by consumers and aimed to take advantage of reasonable expectations that their product is 100 percent pure.
“Defendants intended for consumers to rely on their representations, and reasonable consumers did in fact so rely,” Weisberg claims in her Kedem grape juice class action. “As a result of their false and misleading labeling and omissions of fact, Defendants were and are able to sell the Product to the general public throughout the United States and to realize sizeable profits.”
Weisberg seeks to represent a Class of consumers who purchased Kedem grape juice in the United States. She also seeks to represent a subclass of consumers who purchased the products in New York.
The Kedem grape juice class action lawsuit seeks injunctive relief, monetary damages, punitive damages, court costs, and attorneys’ fees.
