ECO hair gel in woman's hairA class action lawsuit claims that Eco Style Professional Styling Gel products produce flakes, in contrast to advertisements that the products do not.

Plaintiff Vanessa Venus says she purchased an 8 ounce bottle of Eco Style Professional Styling Gel with Coconut Oil in Brooklyn for $1.99.

Venus allegedly relied on the “no flake” advertisements on the front of the label when making her purchase. However, the plaintiff says that the gel does indeed flake in hair.

The Eco Style flaking hair gel class action lawsuit says that multiple products labeled as “no flake” produce flakes, including the following:

  • Eco Style Professional Styling Gel with Coconut Oil
  • Eco Style Professional Styling Gel with Olive Oil
  • Eco Style Professional Styling Gel with Argan
  • Eco Style Professional Styling Gel Krystal
  • Eco Style Professional Styling Gel with Black Castor & Flaxseed Oil
  • Eco Style Professional Styling Gel with Olive Oil & Shea Butter, Black Castor Oil & Flaxseed
  • Eco Style Professional Styling Gel Curl & Wave

Allegedly, all of the above products are marketed with a “no flake” claim. However, the hair gels reportedly produce grayish white flakes that are similar to dried glue.

The Eco Style hair gel flakes class action lawsuit says that manufacturer Ecoco Inc. knew or should have known that its hair gels could cause flakes, because its active ingredient PVP (poly N-vinyl-2-pyrrolidone) is well known in the cosmetics industry to cause flakes. Allegedly, the company has a vested interest in understanding the properties of its ingredients.

Further supporting her claim that the products do indeed flake, Venus cites numerous consumer complaints that the product flakes. Allegedly, many consumers had a similar experience as Venus, because they purchased the product believing it to be flake free but then discovered that it did indeed cause flakes when used.

The Eco Style class action lawsuit argues that Ecoco knowingly misrepresents its products in an attempt to encourage customers to buy them.

Allegedly, the company knows that customers prefer hair gels that do not flake, and attempts to capitalize on this preference to maximize its profit, at the expense of the customers.

According to Venus, had she known that the products would flake, she would not have purchased them or would not have paid as much for them as she did. She claims that she was financially injured by the company’s misrepresentations of its products, and says that other people were similarly misled and financially injured.

Allegedly, Venus and other customers did not receive a product with the qualities that they paid for. Venus says that if she encountered an Eco Style product in the future, she could not rely on the truthfulness of the representations of the product, unless the company made changes to correct the advertising.
