Tarte Inc. has agreed to pay $1.7 million in a settlement with customers who claim the company falsely advertises their “high-performance naturals®” cosmetics and skincare as all natural, when they really contain synthetic ingredients.

If the proposed settlement deal is granted final approval, the Tarte class action settlement provides benefits to customers who purchased a Tarte high-performance naturals products between Nov. 13, 2013 and Jan. 21, 2020.

Plaintiff Jeannie Patora says she purchased Tarte high-performance naturals products at a Sephora store in New York.

According to Patora, she read the products’ advertising that they were all natural. Allegedly, she based her decision to purchase the products partly because she believed these advertisements and was attracted by the lack of synthetic ingredients.

The Tarte all natural class action lawsuit says that Tarte falsely advertises its high-performance naturals products as being free from synthetic ingredients. Allegedly, the products actually contain multiple synthetic ingredients.

For example, the Tarte Skincare Frxxxtion Stick, the Tarte Skincare Brazilliance Self-tanning Face Towelettes and the Tarte Skincare Pack Your Bags Undereye Patches all reportedly contain butylene glycol, glycerin, phenoxyethanol and other synthetic ingredients.

Tarte has not admitted any wrongdoing, but has agreed to settle the false advertising claims to avoid the costs and risks of continuing to litigate.

Class Members who can provide proof of purchase can receive a full refund for their Tarte products. Those who cannot provide receipts or other documentation can submit a claim for $5 per product for up to 10 items.

The deadline to file a claim is Jan. 21, 2020. Customers who receive benefits will waive their right to pursue independent litigation against the company.

Customers may also exclude themselves from the settlement by Dec. 30, 2019. Customers who do this will not receive benefits, but will retain their rights to pursue independent litigation against the company over the issue.

Class Members who do nothing will not receive benefits and will give up rights to use the company about the issue.

Class Members may also object to the settlement by Dec. 30, 2019, or may attend a hearing about the fairness of the settlement on Jan. 28, 2020.

Who’s Eligible

Customers who purchased a High-Performance Naturals product marketed and sold by Tarte Inc. between Nov. 13, 2013 and Jan. 21, 2020.

Potential Award

Full refund for those with proof of purchase. Refund of $5 available for up to 10 products with no proof of purchase. For refunds for up to 10 items, you must state under penalty of perjury the type and number of products purchased, the approximate dates of the purchases, and provide other information including where you purchased the product, and if you were satisfied with it.

Proof of Purchase

Receipts or other reasonable documentation including a picture of the UPC code for each purchased product or a loyalty/membership card print-out.
