A $2.33 million settlement has been reached to resolve claims that certain Sexy Hair shampoos and conditioners are falsely represented as being sulfate-free.

Under the settlement, Class Members include consumers who purchased Sexy Hair Concepts products including Big Sexy Hair Volumizing Shampoo and Curly Sexy Hair Curl Defining Shampoo, since Nov. 19, 2012.

Many consumers look for sulfate-free shampoos and conditioners in order to avoid a reaction to the harsh cleansing agents. Plaintiff Molly Crane filed her class action in February 2017, alleging that Sexy Hair took advantage of this tendency by representing some of their products as being sulfate-free despite containing sulfates.

Crane reportedly read the label of the Healthy Sexy Hair Sulfate-Free Soy Moisturizing Shampoo and thought it would be good for her hair. However, after using the products and feeling dissatisfied, she read the back of the label and allegedly discovered that the product contained sodium sulfate, sodium chloride (salt), and ammonium chloride (a chemical salt).

Crane claimed that she and other consumers were damaged by the company’s misleading statements, prompting her to file a Sexy Hair class action lawsuit against the company.

In October 2018, Crane and Sexy Hair Concepts LLC reached a settlement which they proposed to resolve the class action allegations.

In addition to the $2.33 million settlement fund, Sexy Hair also agreed to stop labeling its products as being sulfate-free unless they truly do not contain sodium lauryl sulfate (SLS) or sodium laureth sulfate (SLES).

Sexy Hair does not admit any wrongdoing by settling the class action lawsuit. The settlement instead provides an avenue for all parties to resolve the claims and avoid the costs associated with continuing litigation.

Under the proposed settlement, Class Members have until March 20, 2019 to file a claim.

Should Class Members file a valid claim, they will be eligible to receive $6 per purchase.

Consumers who do not provide proof of purchase are limited to submitting a claim for no more than two products. Consumers with proof of purchase are not limited in the number of products they can seek compensation for.

Those Class Members who want to object to the settlement or ask to be excluded from it, must do so no later than March 20, 2019.

Who’s Eligible

Consumers who purchased certain Sexy Hair Concepts LLC since Nov. 19, 2012. Eligible products include:

  • Big Sexy Hair Extra Volumizing Shampoo (1.7 oz, 10.1 oz, 33.8 oz, 128 oz.)
  • Big Sexy Hair Volumizing Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz, 128 oz.)
  • Curly Sexy Hair Curl Defining Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz, 128 oz.)
  • Healthy Sexy Hair Soy Moisturizing Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz, 128 oz.)
  • Smooth Sexy Hair Smoothing Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz)
  • Blonde Sexy Hair Bombshell Blonde Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz)
  • Blond Sexy Hair Bright Blonde Shampoo (1.7 oz, 10.1 oz, 33.8 oz)
  • Vibrant Sexy Hair Color Lock Shampoo & Conditioner (1.7 oz, 10.1 oz, 33.8 oz)
Potential Award

$6 per product. 

The Sexy Hair Shampoo class action settlement provides Class Members with $6 per product. Without proof of purchase, consumers can file a claim for two products. Those who can provide a receipt along with their Claim Form may receive $6 per item for all Class products they bought.

Proof of Purchase

Not required. However, Class Members who do not provide a store receipt, evidence of current possession, or other comparable proof, are limited to submitting a claim for two products. Consumers who are able to submit proof of purchase can get $6 per product for each item purchased.
