  • A group of consumers agreed to drop a class action lawsuit against Playtex and Angelcare over claims the companies falsely advertised their Playtex Baby Diaper Genie Refill cartridges contained a one-year supply.
  • The consumers filed a joint motion of dismissal with Playtex and Angelcare without giving a reason for the decision. 
  • The Diaper Genie class action argued Playtex and Angelcare underfilled and mislabeled the refill cartridges by providing far less than advertised.”
  • The joint stipulation of dismissal with prejudice was filed Dec. 2 in a Connecticut federal court.

Playtex Diaper Genie refills class action lawsuit overview: 

  • Who: A group of consumers filed a class action lawsuit against Angelcare USA LLC and Playtex Products LLC. 
  • Why: Consumers claim Playtex and Angelcare misrepresent that their Playtex Baby Diaper Genie Refill cartridges contain a one-year supply. 
  • Where: The class action lawsuit was filed in Connecticut federal court.

Playtex Products and Angelcare USA manufacture, distribute and sell underfilled and mislabeled Playtex Baby Diaper Genie Refill cartridges, a new class action lawsuit alleges. 

A group of consumers claim Playtex and Angelcare falsely market that the Playtex Baby Diaper Genie Refill cartridges come with a “1 YEAR SUPPLY” of diaper bags for its diaper pails.

Consumers argue the Playtex Baby Diaper Genie Refill cartridges, in reality, “provide far less than advertised” and that Playtex and Angelcare deceive new parents “yearning to simplify their lives.”

“Parents pay a premium for an advertised year’s worth of product, but receive a small fraction of what Defendants promise on the Refill Products’ labels and advertising,” the Playtex class action states. 

Diaper Genie refill products don’t actually contain one-year supply, Playtex class action says

Playtex and Angelcare falsely label that the Diaper Genie refill products contain a “1 YEAR SUPPLY,” despite them being “incapable of holding the number of diapers that all but the smallest minority of babies go through in a year,” the Playtex class action alleges. 

“The vast majority of consumers that use Defendants’ Refill Products do not receive a one-year supply of the Products even when following all stated instructions and using the Products as intended,” the Playtex class action states. 

Consumers claim Playtex and Angelcare are guilty of breach of implied and express warranty and in violation of the Magnuson Moss Warranty Act, several states’ unfair and deceptive trade practices acts and New York General Business Law, among other things. 

The plaintiffs want to represent a nationwide class, along with subclasses from North Carolina, Florida, California, Illinois, New York and Connecticut, of individuals who have purchased Playtex Baby Refill products within the past four years. 

They demand a jury trial and request declaratory and injunctive relief along with an award of costs and expenses for themselves and all class members. 

Four mothers filed a separate class action lawsuit involving diapers against Kimberly-Clark Corporation last year, arguing the company sold Huggies diapers containing a skin irritant that can cause chemical burns.
