A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I have a 2010 Chevrolet Equinox that we have had to replace the engine at our expense outside of warranty due to excessive oil consumption and the engine freezing up. How do I get to be a part of this lawsuit?

    I have a 2013 Chevy Equinox that has had major oil consumption problems since my date of.purchase. This problem has often caused the SUV truck to shut off in traffic completely without notice. I complained to GM and called this truck a death trap. How can I Join this law suit

    Yes I own a 2013 GMC Terrain. I just had my vehicle in the shop this week because I keep hearing a rattling noise in engine. I just had an oil change last month and my dealer said that I was out of oil. I keep having to get oil changes and could not understand what the issue was. My body shop just told me about the oil consumption claim. My car is not doing good as it was before & worried my engine is ruined.

    Yes. I own one and have had nothing but problems. I spent over 4000 dollars trying to fix it but Still the same problem. Its annoying having to check and add more oil everytime I drive it!! Please contact me I’m 100 percent sure I’m part of this lawsuit and I do have receipts for all the money I paid.

    I just bought a used 2012 gmc terrain. Well I’ve done nothing but add oil to this car. Can’t even go 3000 miles between a oil change. This is not ok. I bought this car December 19th 2019.

    I own a 2011 Chevy Equinox and just had to have a HUGE repair because of a k own faulty part that burst in the cold weather and all my oil poured out. My mechanic mentioned ed that GM knew about the problem and to pursue repayment. I have no idea how to go about that.

    I own a 2012 Equinox and had the pistons replaced under extended warranty at 75,000. I realized it was doing it again (around 115,000 I believe) but thought I was out of luck from GM. When I recently found out about lawsuit, I am at 140,000 and out of luck. Is there anything that can be done because they obviously never “fixed” anything. They only repaired the damage caused by the problem or design flaw. Very frustrated.

    I have the same issue. 2011 Chevy Equinox with 2.4L engine. Engine went at 135,000 after having continuous problems since purchasing from a GM dealer. I have made multiple calls to GM with very little success. This is obviously a design flaw and they are doing nothing to compensate those of us stuck upside down in a vehicle.

      Me too! I only had my 2013 Chevy Equinox for 9 months at 49,000 miles before I had to trade it in at a dealer. I’m upside down 6g still (it was 11g in 2015) Chevy Corp admitted this was an issue and told me to take it in to Chevy dealer. I did after two mechanics said it was the pistons etc… but if they fixed the problem it may void a warranty so to get it to Chevy. Anyhow the dealer in Hilo HI here (the only one on island ) towed it kept it for a week and said they couldn’t diagnose an issue. Got it back with rats nest in engine compartment and wires had been chewed up. Now I have flooded floor boards, inches of water and living in 85% humidity… you can imagine the odor. Chevy Corp conveniently has NO records of these ongoing conversations and the dealer GM says… WE NEVER EVEN HAD YOUR CAR LADY! Haha. Needless to say, the problems this caused for a single mom running a business (my vehicle -mobile office) is far too much to get into here. But I plan on finding others with similar situations and making sure everyone knows how Chevy REALLY treats their customers! My 1st and last Chevrolet!

    I replaced the engine on my 2011 Equinox about 4 years ago because of the oil consumption issue. How do I get any paperwork to get some reimbursement of the $5,000. I spent to have a new engine installed?
