A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judgeโ€™s order states. The defect necessitates the need for the car owner to replenish the carโ€™s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judgeโ€™s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judgeโ€™s order reads.

The SCAs were put into effect to extend the class vehiclesโ€™ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.ย ย 

โ€œThe SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,โ€ the judge states in her order.

The Settlement Class is defined as: โ€œAll persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.โ€

In addition, the judgeโ€™s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be โ€œappropriate, fair, and reasonable.โ€ This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    My engine needs to be replaced now. Never had the pistons done, but I did have to replace all the coils. Is this all related? I think the engine is because there ended up with no oil in it and I had just added oil about a week or two prior. Do you have to have receipts of work and what work qualifies? Can I make a claim for all of this? I have spent SO much money on oil alone!

    Hello I have a 2014 Chevy equinox that has the same issues as detailed in the information above. It is because of this excess oil consumption that has caused other very costly repairs. If I would have known this issue before the purchase of this vehicle, I would have Not have purchased it.

    We have a 2010 Equinox and we took it in last year for excessive oil consumption. The dealer replaced the pistons and told us it should work like a charm. Since they replaced the pistons weโ€™ve had to replace a fuel injector, the camshaft sensor, etc., etc., and it still consumes oil like crazy. When we get the oil changed in it, the sticker says the next oil change is at 89,xxx miles. However, the Equinox shows that the oil level is at 8% and we havenโ€™t even drove it 1,500 miles! Plus, it costs $50-$65 for an oil change at the dealership which is ridiculous! Is anyone else still experiencing oil consumption AFTER having the pistons replaced?

      The dealership probably didnโ€™t reset the oil level display when they changed the oil. When you have the screen showing oil level you have to press clr (clear) it will ask you if you want to reset or something along those lines. Press yes and then it resets to 100% Donโ€™t just check that monitor. Always go by your dipstick level.

    Wow this is the first I have heard of this!!
    I have a 2013 Terrain that I have had for 3 years. I faithfully get my oil changed BUT in Oct It started to idle rough and I took it to a dealer.
    2 weeks and 3800.00 later I got it back. And the only reason it was ONLY 3800.00 was because a family member works at the dealership and I was able to get a discount on parts & labor.
    Valves, head gasket, actuator, tensioner,Pistons,selenoids,cam shaft, rocker arm.

    I purchased a 2013 Chevy Equinox in October 2017, by December 2017 the engine was blown due to no oil and no warning signal by car. I had to pay $1,700 for a used engine replacement. I have to check oil monthly and constantly add oil. I received notice in the mail regarding Class action Lawsuit, How do I proceed in filing?

    2013 Chevy Equinox ECOTEC engine. Eats oil without any warning lights or indication that oil is low. Called Chevrolet and got the run around. Called the lawyers in the law suit and waiting to hear back from them. Chevy dealership told me today that Chevy/GM issued notice to dealerships last Friday, 1/17/20 that there is an โ€œExcessive Oil Consumptionโ€ on these vehicles. They have to do a 2,000 test to see how much oil it is consuming. They do oil change, you drive 1,000 miles, bring it back to determine how much oil is gone. 1 qt per 1,000 miles. Then they fill it back up, you drive another 1,000 miles and they test again. If you are burning 1 qt of oil per 1,000 miles, they will replace the pistons which is causing the issue.

    I have a 2010 that has had a blown motor for well over a year due to this issue and cant afford to fix it. I have only received the original notice of this lawsuit and nothing further. The longer my car sits the longer its likely to have more problems. When and how do I proceed for the repairs necessary?
