A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I have a 2010 Equinox, bought it from a Dealer in May 2021. I’m wondering if the Dealer knows if the Piston rings have been replaced it had 121,00 miles on the engine at that point..

    My 2015 GMC Terrain, 2.4L motor, with excessive oil consumption, condensation in the oil, PVC and intake get clogged, then freeze, & blow out the rear main seal happened on 1/16/22 with 78k miles. It is at the dealer now. The GM dealer initially denied a problem, I showed them Bulletin 14882, they said there was no coverage for this problem. Gave me the GM Assist 800 462 8782, was totally blown off, never a call back, very systematic.

    Any ideas on how we can join together to make some noise and get some attention?

      This has happened to me twice. It was the rear seal that blew. Mine os a 2017. Stay away from Equinox everyone.

    I bought my daughter a 2013 chevrolet equinox from a private party in feb of 2019- used oil since I bought it. Just checked regularly -well finally the pcv valve iced up I assume with its ridiculous setup that is. Blew out the seal and oil went with no warning light whatsoever. Daughter was stuck in the cold til finally someone came by. I have a service garage to verify. Yes its got 150,000 miles but this whole thing is widespread. Am I just stuck because of their ineptness?? Any help will be appreciated

    I have a 2013 chevy equinox with the oil consumption problem my oil light never came on. There was no knocking of the engine or any indication I had no oil left. I got regular oil changes when they were do and GM said too bad for me. My engine seized up and now I have to replace it. Is there anyway to start a new lawsuit against them? I’m sure if everyone who wasn’t included in the last one can start a new one if we all come together

      Just had the same problem with my daughter’s 2012. And I have a 2013. Her timing chain broke. Oil usage is high. I’m out about 4k. Same with my 2013. Always watching the sticker for date or mileage. Light never goes on to change oil.

      This has happened to me twice. It was the rear seal that blew. Mine os a 2017. Stay away from Equinox everyone.
      I am in for a law suit. Had to replace engine at 130 thousand miles and 25 thousand miles later it happened again. Thankfully when it started making noise I just pulled over and shut it off and called a tow truck. Between the 2 incidents I am in for 10 grand. Not a happy camper.

    I had oil consumption problems with my 2010 Chevy Equinox. Had oil consumption tests done. Engine ended up seizing up and had to junk the car.

    If anybody has any suggestions or comments or knows anything I haven’t received no letters or nothing concerning the soil problem it’s not fair Tony vehicle you can’t drive but I’m still paying close to four hundred some dollars a month between the car payment and insurance

    We bought our 2013 in 2018 it’s been sitting in my garage for the last three years maybe two and a half years now I’m still paying on it $330 a month GM told me that I’m over my miles I have 130 thousand on it I’ve had nothing but problems since the day we bought it the excessive oil going into exhaust cracked exhaust manifold clogged catalytic converter I’m stuck paying with a vehicle that I can’t drive. If anybody can help here’s my cell phone I owe like $8,000 still on this vehicle 609-526-0265

    I own 2013 Chevy equinox. I too have had oil consumption issues. Two years ago the piston rings were replaced by GM. Im starting to have issues again with it burning too much oil.

    I have a 2012 equinox and never received the notice. I’ve had this issue for a while now. What can I do at tihs point?
