A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I purchased a 2013 Chevy Equinox LT on July 20, 2017, from Conklin Cars a Chevrolet dealership in Salina KS. I lived in Spring Texas which was 649 miles away. On the drive back home I realized I used up a bunch of oil. So I had to add more oil. Then after just a couple of weeks of in-town driving, I had to add a couple more quarts again. I should have been able to go 3 to 5 months on the little I drove but instead I had to add 6 quarts of oil just to get to the mileage suggested on the sticker. I then mentioned it to the guys at Firestone where I got my oil changed. They told me to try a better, Full synthetic oil so I did. Then on my next trip home to Kansas, I took it to Concklin, they told me I was over the mileage mark for it to be covered by 45 miles. They knew and sold it to me that way. They then tried to charge me 400.00 in fees trying to find the problem. They then told me to use the Synthetic BLEND and to pay for the SUPER CHARGE OIL CHANGE that should resolve the issue. It hasn’t. They just want me to spend more money. They should have fixed this issue. This should be a recall at this point! It shouldn’t be up to the owner to search and find and reach out for help! I need help now before my engine explodes or they will owe me a new car completely if not already!!!

    I bought my 2013 equinox from Carvana in September 2013. I had no idea about this issues. My car is currently in the shop awaiting a full engine replacement after only 67k miles.

      I’m going through this now. 2013 equinox and my engine is totalled from consuming oil even after 3 oil consumption tests chevy saying I passed and it isn’t. The car wouldn’t start. Took it to the shop and they opened the oil intake and oil flooded out of it and I had gotten an oil change 1 week prior and had not a drop of oil. Now I owe 9000 still and chevy said that even though I did everything right. I’m screwed. They said since nobody has died due to this issue it doesn’t matter.

    2012 Chevrolet equinox 2.4 the dealer never mentioned this recall when I purchased the vehicle now I’m losing about a quart of oil ever 1000 miles but now I’m over the recall mileage by 19,000 miles but I’m just now finding out about this recall. When I got the suv it was under 100,000 miles almost two years ago. What can I do?

    We have a 2013 Eqinuox & our problems began at around 40K miles. After multiple trips back to the dealer they still said nothing was wrong. Then after 100k miles the dealer said we needed a rebuild. This car has been a headache from day 1

    I have a 2011 terrain with oil consumption problems and gm made me jump thru hoops with taking it there every 1000miles to check the oil which I did four times then after that they made me send them all my oil change receipts for the last 4 years which I did ! The timing chain had to be replaced twice which they covered the first one because it was under warranty but the second one I just had to do in Jan of this year and it cost me 2000.00 and now they are telling me that they won’t cover the repairs because it wasn’t within the time limit of the special bulletin that was supposedly sent out which I never got! How can I get in on the lawsuit

    I owned q 2012 Terrain 50,000 miles oil leak in engine know i getting it fixed. 8,000.00

    2012 GMC Terrain 2.4 engine needs rebuilt due to faulty piston rings. The dealer told me I am not covered under any class action agreements or TSB’s and literally wished me luck in getting my vehicle repaired. It’s amazing
