A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I purchased a used 2011 equinox with 73,000 miles and at 122,000 miles suddenly it started to burn a quart and a half of oil every 600 miles. I’ve had the engine fixed and I want to join the lawsuit how do I do that

    Bought this car at a Chevy dealership in 2019 they never once mentioned that there was a recall anything wrong with the car. After about a couple months of having it we question what was wrong with it took it in for an oil change and one time specifically there was nothing in the car so we had to sign a paper stating that we brought this car in with no oil. We bought the car with 85,000 miles now I know why it has such low miles because people don’t drive their equinoxes very far with this huge oil issue. Now my car has over 100,000 miles and because it hasn’t been serviced and because it’s over 100,000 miles GM is now claiming that they can’t do anything about it. So now what am I supposed to do with this car sell it to somebody else and it’s their issue? Now how is that right? Dealership said that they’ll fix the Pistons $3 to $4000 it will cost us. If Chevy already knew this was an issue why wasn’t I notified of about it or why wasn’t this fixed before we bought the equinox? Who needs to be sued the Chevy dealership we purchased it from or Chevy again because all Chevy equinox is that have oil consumption issue should still have to be repaired by the manufacture! I do not feel safe driving this vehicle with my kids in it. dealership told me to run it till it dies, trade it in and they were going to give us $1000, or sell it to Someone else. So now my question is so if I trade it in is this Chevy dealership going to fix it or sell it to someone else. Why is this the solution. The solution should be gm getting in contact with all the owners!

    We bought a 2010 Equinox and it’s burned oil since we bought it. We’ve never been contacted about the class action about getting a repair done.

    I have had oil consumption issues on my 2011 chevy equinox for years but the dealership failed to recognize and issue every time I took the vehicle in. Now I need timing chains replaced and again dealership refuses to cover it. Please help me out

    I have a 2010 equinox with only 140,000 kms or 89,000 miles, the engine would use oil so fast you would have to add a quart every time you added fuel. It ran so low so fast that it developed a knock. We had the engine checked and it needs a complete overhaul or replacement.

    My girlfriend and I have a 2011 Chevy equinox with the oil consumption problem called multiple dealer all said sorry your out of warranty car been out of commission for a couple months I’ve replaced timing chain , balance chain ,tensioner , all guides. , Had to replace numerous wiring connectors it runs again but Everytime I make progress another issues shows it’s head now p0420 code mind you all this had been out of pocket and hours and hours of work I’ve had to put in to this POS car is there anything I can do to get GM to at least repair the piston rings -__- it’s total BS that because there mess up we gotta suffer with this headache of a car /engine

    I had a 2014 equinox that started burning oil around 30000 miles. I was forced to take a loss on it when I sold it. I was fearful of the motor going out :( I think GM owes me a few thousand dollars in losses I incurred

    I have a 2013 that has serious oil problems. Took it to a dealer for oil change and it didn’t even register on the dip stick . No oil light or nothing came on indicating that low oil not even the check engine came on. They said I had to put a new engine in it for 7,000. What can I do ?
