A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judgeโ€™s order states. The defect necessitates the need for the car owner to replenish the carโ€™s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judgeโ€™s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judgeโ€™s order reads.

The SCAs were put into effect to extend the class vehiclesโ€™ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.ย ย 

โ€œThe SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,โ€ the judge states in her order.

The Settlement Class is defined as: โ€œAll persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.โ€

In addition, the judgeโ€™s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be โ€œappropriate, fair, and reasonable.โ€ This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I own a 2013 Chevy Equinox and I am having the same issues. I recently replaced the timing chain and other sensors and i am still having the same oxygen correlation sensor code showing up. What can I do?

    I have 2012 equinox that GM Refused to pay for repairs due to excessive oil consumption. I was 15,000 miles over they said and would not reimburse the motor I had to have replaced

    How do o get chevy to fix my vehicle for free? Injust bought a chevy equinox 2013 in november. Didnt know about this a couple months later my car is running like crap. My mechanic said its tge oil burning problem and tinibg chain and needs new engine, bring to chevy dealer to get fixed. Theres also transmission problems i read about that jas a class action lawsuit. Sll i know is ky car shakes. It has no power on highway. Ferls like thereโ€™s something wrong. If i onky had known. Thereโ€™s about 105,00 miles on it. Oh also both wipers stopped working which is on recall. Seriously?!?! Im kind of pissed. Why, when they k ow there are problems did they keep making these crappy engines?? Vthey cant do this to us consumers and not have to pay. I dpent a heck od a lot of money for a car that was 7ish years old. Who can help me with this. What do i do?

    Had to replace engine in my 2013 Equinox in 2019, at 92,000 miles. Dealer wanted $6000 for new one or $5800 for rebuilt engine. Could not afford that. Got someone to put in an Equinox 2012 engine to keep me going. Been fine til this month when I was told I had an oil leak. Will this class action cover any of my costs on this issue?

    Similar issues as the rest of the post. 2012 GMC terrain. Major oil consumption. Now the timing chain is making a noise. Wish gm would do something about this. Due to the current economy etc I canโ€™t afford to fix this.

    Same deal as everyone else. Brought my 2012 Chevy Equinox in 2012. Never had a problem with burning oil until last year. Was never informed about any recalls. Chevy dealer did the leak check, found that the equinox was burning oil. They contacted GMC and GMC only offered me $1000 due to me having 135,000 miles on the equinox.

      GM put the issue on the VIN so they donโ€™t have to for all the 2.4 ecotech they know have a defect. I have a 2011 Equinox with the identical issue. They dealer knows of the issue. The VIN should NOt matter. The service tech was told not to touch these cars with out money down or in hand. Looking for legal counsel.

    I just purchased a used 2012 equinox 4 cylinder and was not aware of the class action lawsuit until I purchased the car and after less then 3,000 miles found it 1 1/2 quarts low on oil. Purchased the car at 124,000 and now has just above 127,000. How can I find out if this vehicle can qualify and what to do?

    My 2013 Equinox has been running great. Then last week, we noticed a slight misfire, but since we were going on a trip, I thought it would be a good time to change the sparkplugs. My husband changed them and then it started running really bad. My dad picked it up yesterday and took it to a shop. I got a call today saying the engine was severely damaged because of a piston and there was no oil (I get my carโ€™s oil changed religiously and the low oil light never came on.)

    My husband and I have been absolutely sick over this.
