A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judgeโ€™s order states. The defect necessitates the need for the car owner to replenish the carโ€™s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judgeโ€™s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judgeโ€™s order reads.

The SCAs were put into effect to extend the class vehiclesโ€™ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.ย ย 

โ€œThe SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,โ€ the judge states in her order.

The Settlement Class is defined as: โ€œAll persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.โ€

In addition, the judgeโ€™s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be โ€œappropriate, fair, and reasonable.โ€ This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I too own a 2014 Chevy equinox. My.car broke down two weeks ago. I bought this brand new. I have noticed that it has been burning oil really fast. I was in my way hone from work and had no notice or wanting a our anything at all and went to back up and my car died. Still no warning lights nothing. Then I started it again and it died again. But this time was in the road. I managed to get it started again. And notice a trail of oil as I was getting to a driveway.. I have had a couple people, mechanics, look at it and they are puzzled on why my carโ€™s rear main seal blew with no warning lights about oil pressure or nothing. My car has been burning around 2 quarts a week but yet not once did it leak oil untill seal blew. So now I may lose my job due to not having a vehicle! . To know it couldve been avoided really makes me mad considering I paid 465.55 a month from 2014 to 2019.not happy and will neber go to a Chevy dealership again

    I too own a 2013 Chevy Equinox that has been burning oil at a fast pace โ€ฆ. I am in the process of doing an oil consumption test now โ€ฆ.. I wish to join class action lawsuit as well.

    I drive a 2015 Chevy Equinox. My car started having rapid oil consumption issues described in the 2010-2013. I reached out to GM they will provide some cost assistance but leave me to pay 1,200 out of pocket. This seems like negligence because this is clearly a known problem that has not been addressed in the newer models. Are newer models going to have another suit coming up?

    My 2013 Chevy Equinox LT, was under the oil consumption 2,000 mile test, however, I would have been over 126,000 miles after the 2,000 mile test period, so they refused to commit to pay the $4,600.00 repair!!! How do I get enrolled in a lawsuit?

    Iโ€™ve owned my 2013 Chevrolet Equinox since it was brand new. It currently has 146,000 approx miles on it. It consumes oil at an alarming rate and when I get it โ€œtopped offโ€ at my oil change place between changes, it has dropped over a quart between 3,000 mile changes. It also knocks and rattles just before getting it topped off. I received a letter dated January 17, 2020 from GM about this issue and that they would โ€œprovide additional protectionโ€ for this problemโ€ฆ โ€œif it occurs within 7 years and 6 months or date your vehicle was originally placed in service or $120,000, whichever occurs first, the condition will be repaired for you at no costโ€ Of course I received this letter when my car was just beyond the previous conditions. My car is still having this problem and has not been repaired. I would love to get this fixed and be a part of this class action lawsuit.
