A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I have a 2013 Chevy equinox took my car in to the dealership for all maintenance not once did they mention any issues with the engine until my warranty was up then they told me I had to replace the engine. I replaced the engine with another one that had 30,000 miles on it and wouldn’t you know it. It had the same issues. What can 3 do regarding this matter.

    I have a 2012 chevy equinox which has been consuming excessive amount of oil for 6 months now. I have to add 2quarts of oil between oil changes just to get the oil level on the oil stick. I called GM about it and they informed me that I’ll have to pay for any repairs because my vehicle is not on the list of recalled vehicles based.on my vin number. Please, is there anything you can do to help?

    2013 Equinox LT awd.

    Consumes oil no matter how easy or hard you drive. Consistently adding a quart.

    Something needs to be done about the transfer case. If you own this vehicle and your transfer case hasn’t been replaced. It will fail! No doubt.. so mine self destructed with no warning at all right at about 120k miles.

    Also this thing has excessive rust everywhere underneath. Along the bottom of the front doors is terrible..

    I’m calling gm and seeing what can be done. If no compensation, I’ll walk b4 I buy another gm product.

      Bought a 2013 chevy equinox, started burning oil at 2 yrs old and 20k miles. Took it in for “oil consumption tests” at the dealer it was burning 1/2 quart every 1000 miles. Did that three times same results and local chevy dealer Lester Glenn location on rt 9( was pine belt back then) said that it was normal and acceptable to burn that much oil. Went to corporate gm same answer that it was normal. Years later there was class action lawsuit about the same issue. Took the truck back to Lester Glenn chevy in freehold and they did more oil consumption tests and the levels were just below the threshold that was set in the class action lawsuit and chevy/gm again said it was normal to burn that much oil.

    I have a 2013 equinox that blew a rear main seal. I have serviced this car as o should and during the cold and snow it just blew without warning. My mim has a 2014 and it’s blown too!! Both with less than 100,000 miles! I would like to know HOW TO JOIN THIS LAWSUIT

    I have a 2013 terrain with it 2.4 eco-tech motor. It was a high oil consumption motor end it finally blew out the rear main seal on the motor. It was out of warranty. So my mechanic tried to repair it with a new seal. But it still leaked. Now we just replaced the motor itself with a good used one.I don’t recall receiving a claim form. After spending 5000 on a good used motor I certainly wouldn’t mind a little reimbursement.

    I have a 2013 Chevy Equinox, that stalled multiple times while driving, this started 2 weeks ago. Before that when I would stop the car would jerk like it was going to stall out. Took it to a Chevy dealer whom said the pistons were shot, metal shavings everywhere in the engine, said caused by the excessive oil consumption. Now I am forced to replace the entire engine, as the dealership told me the vehicle can no longer be driven. How can I get reimbursed for all the repairs? I never received any paperwork in the mail regarding a settlement.

    I have a 2011 equinox and have tho problem. I have had to get oil changes too frequently and still do. I still have to keep oil in my car because it. Burns it so fast. I have many repairs to fix the issue. I received two letters about the claim and mailed them back in. I have never heard anything else about the lawsuit. Please help
