A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

Bought. 2012 Equinox from private owner….want to join class action lawsuit. Engine seized up. Even though dash showed 75% oil.

  2. Sarah Kendrick says:

Why was the 2014 not included in the lawsuit! I have a 2014 with less than 100k miles on it that had been well-taken care of and serviced by GM regularly and now sitting at the chevy garage Due to this Issue. And it is going to cost me 7600.00 to have it repaired by the dealership! This is ludicrous!! HOW do we open a new lawsuit against GM for the 2014 that were affected by this same exact issue?

  3. Kevin Fish says:

Have a 2011 equinox. Bought with 90k miles.. ever since I bought it, it seemed like I had to change oil earlier and earlier. Took too dealer and complained of loud noise and oil consumption. The replaced timing chain. It was quite after that, but oil consumption remained the same. It now has 178k. But I religiously put 2 quarts of oil in about every 2 weeks or so. Not happy! This year pvc system froze up… and had negative pressure… almost blew my seals. Caught it in time. This thing is a lemon.

  4. Sara Brogdon says:

I had a 2012 equinox with 2.4L Motor. Changed cam shaft seloniods 4 times in 14 months. I constantly lost 1 quart of oil every 2-3 weeks, more if I made any trips. In September of 2020 my timing chain busted and garage said it took out motor. I was quoted 5-6500$ to repair. That was not an option for me. I had to let it go back after paying 4 yrs. Which now is showing bad on my credit as well as owing 6500 after finance company “fees and remainder of loan”. I received a letter from lawyers, but never received any compensation…..

  5. Beth A says:

Has anyone else received a ridiculously small check? This article says everyone will get $4500… I received a fraction of this

    1. Carla Kurtz says:

I have not received anything as of yet ….still waiting for payment I had all of the paperwork turned in well before the due date

  6. Debra Pruitt says:

  7. Katherine Kelley says:

I have a 2015 Equinox. Regularly change the oil. My service tech never said a word about the engine issue. At 122,707 it blew the engine. I just paid 6500 bucks to replace the engine. This should not have happened and there should be some sort of recourse! CHEVROLET is aware of this issue why have they not fixed the issue and why are they allowed to continue to produce this engine?. My Onstar diagnosistic did not detect an issue.

  8. Paul says:

There should be another lawsuit for 2104 & 2015 2.4L engines … I have one of each and right at this moment both are suffering the same issues, one blew a rear main and the other has the exact same codes and is undrivable, but no blow rear main. The one that blew the rear main is a 2015 Terrain with 58,000 miles on the engine and is still under warranty, The other is a 2104 Terrain with 90,000 miles on the engine and it is not under warranty.

  9. lawanda Conner says:

I too am changing synthetic oil changes way to fast. I am just finding out about the lawsuit What should I do? I have 2012 Chevy Equinox with 161177 miles

  10. Bryan says:

Currently going back and forth with my dealer over the out of pocket cost for the excessive oil consumption repair repair n my 2013 equinox. I brought the vehicle in prior to the cutoff and they charged me for part of the repair. I now am also having more issues with the vehicle that started right after them repairing that I never had prior to them touching it. Please let me know if you can help in anyway.
