A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    I have a 2012 chevy equinox. Most recently my dash displayed an wrench with the words service stabiltrack followed by an exclamation mark with the words engine power reduced, the check engine light turned on and then my car powered off. I had a local mechanic look at my car and he discovered metal shavings in the oil from my oil. He asked if i have had issues with my oil. I told him yes. When i get my oil changed, they tell me my oil is low. He then directed me to this class action settlement. I fear that i am too late to be involved, however. I am so afraid to even drive my car. What can i do?

    Yes I got my 2011 equinox in 2015. First month we had major issues. The dealer said no oil in engine. After it was not getting better got 2nd opinion from Chevy dealer oh the engines pistons need to be changed. All said had more bad times than good. Why I kept paying on this and the money put in it back to where we were when timing chain blew metal all in the motor was fixed and doing same again. Saw the lawsuit but oops over the 120000 miles so I am out of luck. Hope all those cars out there no body buys. Chevy should take and crush all the ones for sale with bad engines. Bye Bye Chevy Equinox.

    I have a 2014 Chevrolet Equinox, it is showing all of the symptoms of burning oil at a high rate. Are 2014 part of the class action lawsuit?

    I own a 2010 GMC Terrain 3.0 sle also i was not told about what’s going on with these vehicles but my vehicle constantly ask for oil and last couple of months check engine lite been on codes are p0017 p0054 p0060 it drives roughly and starts with rough idle gmc never sent me a letter indicating the failure of these vehicles also the dealership that is selling gmc so please keep me posted on how to claim or acquire general motors to fix this problem

    My 2014, bought new from dealer, had to have a new motor d/t burning oil. My Vin # wasn’t one listed in the lawsuit. Will the 2014 be added??? I’m over $5000 in debt from this fix.

    I’m having the same issue with my 2015 GMC Terrain. As soon as it hit 80k the camshaft became faulty- started eating up oil and now the engine needs to rebuilt.

    I have a Chevy Equinox using too much oil. I am in negotiations with the dealer for repair and close to their 120,000 mile limit. If they decline to fix it, how can I get reimbursed from this lawsuit?

    I purchased a 2013 Chevy Equinox in 2018. It uses quarter of oil a week and now my check engine light is on giving me the code for a catalytic converter, which could be due to the oil consumption. I am just finding out about this oil consumption class action suit this month but when I called my local Chevy dealership I was told that I missed the deadline. I was never notified that there was an issue so now they are saying out of luck and I would have to pay to get it fixed which could range from 3600 to 7200 dollars depending on the problem. My car has over 150,000 and unfortunately I still owe some on it and I don’t know if its worth putting that much into it. Therefore, any assistance would be greatly appreciated.

    I just purchased my vehicle in 2020 and I’m having the same problems what are you gonna do for those who purchased after the date do I have any entitlement to the lawsuit as well
