honda dealershipPlaintiffs have secured a $1.9 million payment and the forgiveness of $19.8 million in debt in a class action settlement over allegations that Honda failed to properly inform car owners of their rights in repossession.

Further, the car maker allegedly hiked up the debt owed on the reposed cars when the vehicles went to auction.

In addition to the payments and debt elimination, Honda has also agreed to inform three major credit reporting entities that negative reports from debt related to repossessed Honda vehicles should be removed.

“The agreement provides substantial benefits to the class of Massachusetts borrowers whose cars were repossessed by American Honda Finance Corp.,” noted the motion for approval of the Honda Repo class action settlement. “The agreement negotiated by the parties is fair, adequate and reasonable.”

The lead plaintiff Rachel Williams alleged that she was subject to a Honda repo. The car maker reportedly sold her car at auction for $8,900 but failed to properly disclose to her why there was a difference between what she owed and the fair market value of the vehicle.

The notice purportedly included information about the deficiency balance obtained by subtracting what Honda got at auction for the car from the outstanding loan balance; however, the cost of repossessing and selling the car was factored in.

The Honda repo class action lawsuit contended that the car maker’s deficiency notices sent to consumers when their vehicles were sold at auction did not comply with Massachusetts state law.

Class Members in the Honda repo class action lawsuit include those in Massachusetts who had their vehicle repoed by Honda from April 2010 until July 2018.

Class Members must have taken out their vehicle loan through Honda and had their vehicle repossessed by the car company.

Additionally, the debt must not have been discharged in bankruptcy and Honda must not have obtained a deficiency judgment against the person who took out the car loan.

According to the proposed settlement notice, 4,183 Class Members have been identified using Honda’s records.

U.S. District Court Judge Leo Y. Sorokin granted preliminary approval of the Honda repo class action settlement.

If the settlement receives final approval, Class Members will not need to take any action to take part – they will automatically be entered into the Honda repo class action lawsuit unless they opt out or object to the terms of the agreement.

Honda does not admit any liability under the terms of the class action settlement, but says it entered into the agreement to avoid the uncertainty of litigation.

The plaintiff’s attorneys have requested $950,000 in costs and fees in the Honda repo class action settlement.

    HFS told me after 90 days is when they can take your vehicle. I was backed up 2 payments and I have notified them when I was going to catch up. However that didn’t stop them. I woke up to take kids to school and car was gone. And they still didn’t send a repo letter or anything. I found out from the police of what happened to the vehicle .this is in New Jersey

    Yes, I was duped by Honda Finance as well. They hiked up the price after I paid almost 5,000.00 to retrieve my car and the prices quoted were increasing daily. The repo disclaimer was never mentioned. They are still calling me for payments and reporting negatively on credit report.

    My car was reposed on june 29. I paid in full on july 2. They refused to release my car. I have proof of payment. It is july 21 and honda told me that they are selling my car on the 29.

      Im a victim Honda dealer at Chula Vista Ca now Penske Honda it’s been a 1 year 1/2 now. I’m really upset hot and bothered felt discriminated against finance were not willing to help showing actions them caring less; blowing you off. Making dumb comments well if you can’t afford to return it. Their attitude was negative did not wish to hear my situation. I took the vehicle to Baja I sincerely believe I have been discriminated bullied unfairly mistreated after my. 2016 civic being repossessed I paid $3,500. To obtain my car back less then a month my car was active again for repossession I was WT… when I took the car out from the repo yard finance brought me up to date. When that one month past I
      Was told I f have fallen behind again and that my car will be repoed again i want to keep my car but Honda finance never answer they only answer when they want they will not help you only prolong and forcing you to wait days to extend and adding more storage fee and finance adding another month which is not due yet making it harder oneself from taking and keeping the vehicles When being on the phone with i see that car got repossessed unfortunately I have not yet received a released approval from my supervisor please call back tomorrow and you call again same story waiting to obtain a release form for approval and the amount be different; their work ethic sucks as well as their system i refuse to give up my cars so it can go to auction. I know my debt will still remain and my credit ruined I want to be heard and that no other consumer(s) goes what I had to go through ball homda now homda Penske – Honda finance. Will not work with you including and leaving information out needed to be addressed they will have you go in circles once at yard they will tell you a repossession release form is needed from the highway police we need them to release the vehicle; these 2 party’s be pointing fingers at each other and prolong from releasing the car .adding more debt . Can anyone help..

    They just did this to me are there any openings to jump in on this? They literally stole my car from me at the butt crack of dawn on a Sunday morning never said a word about it I hadn’t even had the car for a year it was 6 months with a trade-in of almost $3,000 and monthly payments that were being paid for on my behalf as I’ve got medical disabilities and have had trouble with work but nonetheless Honda took the car I never got notice about where was never got any of my belongings out of it which were very expensive and they cut off one of the major earning opportunities that I have. Trying to start my own business and major side hustle was delivering and driving for Uber and the rest of the delivery rideshare partners.
    Furthermore they sort of let me know about the extension I could file for which was only doable through facts ( high year 2019-2020?) Call them on the day of the deadline and was informed then spent hours running back and forth across a major highway that separated me from a UPS store where I had to physically send a fax and pay for those faxes to go through each time being told this was not there this was not there this was not there. insane stipulations. Looking back were all just so that they could steal and sell my car because not only did they deny ever getting my facts that was finally correct after sending 5, but they also sent my car to auction and sold it. I now have a bill as well that they sent me for $7,000 because of the difference in the car sales revenue. I called them every single day multiple times could not get to the lead that I was instructed to speak to. Never got in my belongings. Just totally abused by this company and I don’t know what to do for help because nobody wants to deal with this. I don’t want to deal with it but I don’t have much of a choice I can’t sit back and let things like this happen in our society I won’t stand for it.

    I had this happen to me. I got letter after sold at auction and I have 3 different credit reports all different in reporting. Also I have 3 different amounts owed.. I want to be contacted and part of this..

    Same thing happened to me with HFS. I’m in Ohio. They have reported inaccurate info on my credit report, changing good payments to bad, refused payment, repoed my vehicle and refused to give me a sale date or anything. The next time I heard about the vehicle it was transferred to a collection agency.

    At this point I’m not sure where to start or what to do.

    I would like to be part of this lawsuit settlement against Honda Finance Corporation. I have the letter from when they sent me over a collection agency for repossession.
    I am hoping that this will be taken care of immediately.
