GM Shift to Park Error Class Action Lawsuit Overview: 

  • Who: Chevy owners have lodged a class action lawsuit against General Motors LLC (GM). 
  • Why: Plaintiffs allege GM is refusing to fix a defect affecting hundreds of thousands of its popular Chevy vehicles, including the Malibu, Volt, and Blazer.
  • Where: The class action lawsuit was filed in Michigan federal court. 

General Motors (GM) designed, manufactured, marketed, distributed, serviced and sold vehicles that fail to detect when they are put in park, instead signaling a “shift to park” error, a class action lawsuit alleges. 

Lead plaintiffs, James Bertagnolli, Gregory Fladeboe, and Juanita Crawford allege the shift defect affects hundreds of thousands of 2016-19 Chevrolet Malibus, 2016-19 Chevrolet Volts, 2018-19 Chevrolet Traverses, and 2019 Chevrolet Blazers. They want to represent owners of those vehicles in a class action lawsuit filed in Michigan federal court. 

Bertagnolli, Fladeboe, and Crawford claim the shift to park defect does not allow them to shut off their vehicles and Chevy owners must resort to “tricking” their vehicles into detecting that the vehicles shift lever is in the park position. 

Automaker Will Not Fix Shift to Park Defect

The class action lawsuit alleges GM had knowledge of the defect, as evidenced by posting a bulletin to its dealerships back in 2017, however failed to address or resolve the issue with drivers.  

The plaintiffs say that they and other Chevy owners are forced to fix the shift to park error at their own expense. 

The plaintiffs claim this is a breach of contract on the behalf of the Defendant and is in violation of the Magnuson-Moss Warranty Act, which governs warranties on consumer products. 

“Had Plaintiffs and other proposed Class Members known that the defect existed at the time of purchase or lease, they would not have bought or leased the Class Vehicles, or would have paid substantially less for them,” states the shift to park class action lawsuit. 

Bertagnolli, Fladeboe, and Crawford are seeking damages and restitution from General Motors for themselves and on behalf of all others similarly situated. The plaintiffs are also asking the automaker to notify all Class Members about the shift defect. 

Another class action lawsuit filed earlier this month against General Motors alleges it knew millions of its SUVs were fitted with defective airbags and seatbelts

The allegations came just days after the car manufacturer issued a recall on 50,000 of its Chevrolet Volt electric vehicles determined to be a fire risk on account of a battery defect.

    Experience “Shift to Park” messages now quite frequently with 2019 Traverse. Began as very rare occurrence but now almost all the time. So far been able to work around with more forceful push into park.

    This is the 2nd time this has been repaired on my 2018 Traverse. The first time it was within the warranty period, this time was not and the extended warranty won’t cover. They have you over a barrel and smile when they hand you a bill over $800.00. They expressed their sincere apology for the high dollar amount of a part that is known to be manufactured with a built in failure. But there is nothing that they can do except collect your money. The mob would have loved a con like this.

    YUP; I’m in the same boat!!! I’m sitting at my dealer’s service department getting repairs for the SAME EXACT issue with “shift to park”!! The diagnostic test, parts, and maintenance is going to cost me well over 500 bucks!!!! And of course my extended warranty doesn’t cover any of this repair either!!! I’m totally ANGRY! I have ALWAYS bought Chevy vehicles, but am having second thoughts after researching and finding out that this issue has been a problem with MANY GM vehicles since 2017!!!!!!

    I now have my 2018 traverse in for this problem with 35000 was told it is the gear shifter and the cost is 507.40 don’t know why they aren’t forced to cover this known problem.

    I live in Michigan and my 2018 Malibu started doing this about 2 weeks ago. My coworker who has a 2016 is also having the same problem.

    I have a 2018 Traverse and this just started happening. I have to restart the car and try multiple times to shift from Drive to Park in order for the car to shut off.

    My 2019 Chevy blazer only 28,000 and shit to park error is coming up they told me warranty is up 21 days so cost on me

    Just got my 2017 Volt back from dealer that charged me $196 to fix “shift to park” issue. I know things will break over time but didn`t realize how common this problem is and how long GM has been ignoring it. Dealer even told me it is an extremely common problem.

    Our 2019 Chevy Volt left us sitting numerous times. The problem all started with the “shift to park” message. After multiple trips to dealers for service, it left us stranded along a highway at night. Finally, the dealer said manufacturer said we needed new transmission. Car was fine for about a year and now we got a ‘shift to park’ message yesterday. We’re taking to dealer immediately because we don’t want the car shutting off on us in traffic as it did numerous times in the past.
