Canadian dishwasher owners have secured a class action settlement resolving claims that certain Whirlpool, Kenmore, and KitchenAid brands of dishwashers contained a defect that led to overheating.
Class Members include residents of Canada who owned a Whirlpool, Kenmore, or KitchenAid dishwasher manufactured between October 2000 and January 2006. The brands and model numbers of the affected dishwashers are listed here.
The Canadian dishwasher class action lawsuit claims that certain models contained a dangerous defect — an electronic control board that was prone to overheating. The plaintiff said that, as a result, dishwashers could overheat, emit smoke and even sparks, potentially leading to a fire.
Plaintiff Kristina Essa alleges that she spent $1,000 on a new dishwasher in 2004. In 2015, the dishwasher overheated and started smoking and caused a fire. The plaintiff said that she suffered property damage and financial loss as a result of the defective dishwasher.
The Canadian dishwasher class action lawsuit claimed that Whirlpool, the maker of the allegedly defective product, knew or should have known about the problems the electronic control board would cause. In addition, the company allegedly violated Canada’s Fair Trading Act by failing to disclose the defect.
Under the terms of the Canadian dishwasher class action settlement, Whirlpool has agreed to provide rebates and reimbursement to Class Members. Class Members whose dishwashers have not overheated can claim a cash rebate.
Class Members can claim a 10 to 20 percent rebate on the purchase of a new Kenmore, KitchenAid, or Whirlpool brand dishwasher, depending on the repair history of their dishwasher.
Canadian dishwasher owners who have experienced an overheating event can claim reimbursement of costs, up to $300 if the dishwasher was replaced, $100 cash payment, or a 30 percent rebate on a new Whirlpool dishwasher.
Class Members seeking a cash rebate will need to register with the rebate program by Nov. 15, 2019, and be able to provide their proof of purchase.
Most Class Members seeking reimbursement will need to provide proof of qualifying expenses related to the repairs and/or replacement of their dishwasher; however, Class Members who receive a settlement notice with a claim number that begins with “2” will not have to provide proof.
Class Members in the Canadian dishwasher class action settlement who experience an overheating event in the future, either within 10 years after the purchase of the dishwasher or by May 27, 2021, will need to contact the Settlement Administrator within 120 days of the event.
The deadline for Class Members to object to or opt out of the class action settlement is July 26, 2019.

Class Members include residents of Canada who purchased or owned certain models of Whirlpool, Kenmore, or KitchenAid dishwashers manufactured between October 2000 and January 2006. The makes and models are available here.
Potential Award
Up to $300 and rebate toward new dishwasher.
- “Reimbursement for Paid Qualifying Repairs: If you are a Prequalified Class Member, or if you provide sufficient documentary proof that you actually paid some out-of-pocket cost for a Qualifying Repair (parts or labour), you will be reimbursed for the amount that documentary proof shows you paid for parts and labour, up to the full cost of the Qualifying Repair. If you provide sufficient documentary proof of a paid repair, but the proof does not show the amount paid, you will receive $200.
- Reimbursement for Paid Qualifying Replacements: If you are a Prequalified Class Member, or if you provide sufficient documentary proof that you paid for a replacement dishwasher as a result of an Overheating Event, Whirlpool will reimburse the out-of-pocket costs paid up to $300 for a Whirlpool-built replacement dishwasher (e.g., a KitchenAid®, Kenmore®, Whirlpool®, or Maytag®-brand dishwasher) and up to $200 for a non-Whirlpool replacement dishwasher.”

Documentation of expenses related to an overheating event required for reimbursement or replacement claims.
Class Members who received a claim number starting with “2” do not need to submit proof of replacement.

Whirlpool Dishwasher smoked out and had to be replaced. Filed a claim, however, did not see my model number on the list. please add me
This exact same thing happened to my Kitchenaid dishwasher. However, it looks like I’m not eligible for the claim because I live in the U.S. The repair cost more than what my dishwasher was worth. They should open it up to U.S.
