U.S. Polo Association agreed to a class action settlement to resolve claims that it misled consumers with fake sale prices.
The settlement benefits consumers who purchased merchandise from any U.S. Polo Association outlet stores in California between July 12, 2015, and June 24, 2022, and who did not receive a refund or credit for their purchases.
The U.S. Polo Association is the governing body of polo in the United States. The association promotes polo games, coordinates club activities and provides other benefits to registered players. The U.S. Polo Association brand sells authentic polo clothes and accessories.
According to a 2019 class action lawsuit, U.S. Polo Assn. stores use fake reference prices to convince consumers they are “getting a good deal.” This impression allegedly causes consumers to make purchases they wouldn’t have if they knew the truth. In reality, the merchandise sold by U.S. Polo Assn. stores was never actually sold at the reference prices, the plaintiffs contend.
“[U.S. Polo Association] intentionally represented — on the price tags of U.S. Polo Outlet Products — ‘Reference Prices’ that were overstated and did not represent a bona fide price at which U.S. Polo Outlet Products were previously sold,” the fake sale prices class action lawsuit contends. “Nor was the advertised Reference Price a prevailing market retail price within three months immediately preceding the publication of the advertised former prices, as required by California law.”
U.S. Polo Association hasn’t admitted any wrongdoing but agreed to resolve these claims with a class action settlement. The settlement fund total has not been disclosed.
Under the terms of the fake sale prices settlement, class members can receive one of two merchandise certificates.
With the first certificate, class members can receive a 10% off the first $100 of any merchandise purchase. The second certificate offers $5 off any purchase. For both certificates, no minimum purchase is required.
These vouchers are valid for four months after issuance and can be used in any U.S. Polo Assn. outlet store in California or on the company’s online store. The certificates are non-transferable and cannot be combined with other discounts or promotions.
U.S. Polo Association has also agreed to provide injunctive relief. Specifically, the company promises to maintain pricing and labeling practices that comply with California sale regulations and state laws.
The deadline for exclusion and objection is Sept. 22, 2022.
The final approval hearing for the U.S. Polo Association fake sale prices settlement is scheduled for Oct. 21, 2022.
In order to receive settlement benefits, class members must submit a valid claim form by Sept. 22, 2022.
