Thinx agreed to a $4 million settlement to resolve a class action lawsuit claiming its period underwear is made with dangerous chemicals linked to serious health concerns — and no proof of purchase is required for class members to submit a claim.
The settlement benefits consumers who purchased certain Thinx period underwear between Nov. 12, 2016, and Nov. 28, 2022. The settlement covers Cotton Brief, Cotton Bikini, Cotton Thong, Sport, Hiphugger, Hi-Waist, Boyshort, French Cut, Cheeky and Thong style Thinx underwear products.
Plaintiffs in the Thinx class action lawsuit accused the period underwear manufacturer of adding dangerous polyfluoroalkyl substances (PFAS) to its products. PFAS chemicals are used due to their non-stick and water-resistant qualities but may cause serious health problems, including cancer.
Thinx is a brand that sells a number of menstrual and incontinence solutions including period underwear.
Thinx hasn’t admitted any wrongdoing but agreed to a $4 million class action lawsuit settlement to resolve these allegations.
Under the terms of the class action lawsuit settlement, class members can receive a cash payment or voucher for their Thinx purchases, even if they have no proof of purchase.
With proof of purchase, class members can receive a refund of up to $7 for each eligible purchase of Thinx period underwear. Class members can claim up to three Thinx purchases for a maximum payment of $21 with proof of purchase.
Without proof of purchase, class members can receive a refund of up to $3.50 for each eligible purchase. Class members can claim three eligible purchases for a maximum payment of $10.50 without proof of purchase.
Instead of a cash payment, class members may choose to receive a discount voucher. This settlement voucher offers a 35% discount on future Thinx purchases of up to $150. The maximum discount for this voucher is $52.50.
Vouchers can be used to purchase a number of eligible products including Air Bikini, Air Hiphugger, Boyshort, Cheeky, French Cut, Heavy Boyshort, Heavy Hi-Waist, Heavy Hiphugger, Hiphugger, Modal Cotton Bikini, Modal Cotton Boyshort, Modal Cotton Brief, Modal Cotton Thong, Modal Heavy Cotton Brief, Modal Super Cotton Brief, Sport, Super Hi-Waist, Super Hiphugger and Thong Thinx underwear.
Thinx has agreed to non-monetary relief as part of the lawsuit settlement. The company will reportedly take steps to ensure that PFAS chemicals are not intentionally added to Thinx period underwear and will continue to monitor raw materials for PFAS. Thinx also agreed to disclose the use of antimicrobial treatments such as Agion.
The deadline for exclusion and objection is April 12, 2023.
The final approval hearing for the settlement is scheduled for May 24, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by April 12, 2023.
