A new class action lawsuit claims that JCPenney uses fictitious original prices for sale items on its website to make them appear to be at a greater discount than they actually are.ย
Plaintiffs Marjanique Robinson and Ariana Skurauskis allege JCPenney uses so-called false reference pricing to induce consumers into making a purchase under the mistaken belief they are โgetting a bargain.โย
โSellers, including Defendants, continue to engage in this tactic because they know they will be able to increase sales and profits by tricking consumers into making purchasing decisions based on the advertised reference prices,โ the JCPenney class action says.ย
Robinson and Skurauskis want to represent a nationwide class and California subclass of consumers who, during the class period, purchased one or more items from JCPenney at a discount from a higher advertised reference price.ย
JCPenney โintentionally and deliberatelyโ misleads consumers, class action claims
Robinson and Skurauskis argue JCPenney knew or โshould have knownโ that its use of false referencing pricing would mislead consumers into thinking they were getting a bargain.ย
โDefendants intentionally and deliberately implemented a pricing scheme that was designed to mislead its customers,โ the JCPenney class action says.ย
Robinson and Skurauskis claim JCPenney is guilty of fraud and negligent misrepresentation and violating Californiaโs Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act.ย
The plaintiffs demand a jury trial and request injunctive relief and an award of economic, actual, monetary, consequential and compensatory damages for themselves and all class members.ย
The complaint comes more than a year after a consumer filed a similar class action lawsuit against JCPenney over claims it used false original prices for sale items on its website to make them appear at a larger discount than they actually were.ย

I purchased a Down Coat from J. C. Penny that was supposed to be marked down at least 50% from $250, w/a $25 discount coupon. I paid $100 +tax. Later I saw the same cost advertised for 50% off of $200. I watched the price for four (4) and the original price changed 3 times.
I purchased online from them and had a similar experience.

I would think I was getting a great deal until you get to the register and oh you canโt use this with that .So where is the great deal? So misleading

I have shopped at jcpenney for years and have noticed this practice with the pricing. I was wondering how long they were going to get away with it.
I thought I was receiving a great deal when I shopped at JCP! Now I realize they were making it look like a great deal! Please include me!
Stores claiming the biggest sale of the year and all of these percentages off need to stop. Switch and bate with prices. I went into JC Penny this weekend and there was a section of the store marked at 50% and 80% off and nothing was marked in those ranges.
