Authentic Brands Group misleads consumers about the actual amount of Supima cotton in its Brooks Brothers brand white Fitted Non-Iron Stretch Supima Cotton Dress Shirts, a new class action lawsuit alleges.
Plaintiff Robin Weeks claims testing shows that the Brooks Brothers dress shirts contain “significantly less” than the 97% Supima cotton their labeling purports.
Weeks argues this alleged misrepresentation injures consumers who place a higher value on products made with Supima cotton “because they are softer and more durable than products made from non-Supima cotton.”
“Defendant sold more of the Product and at higher prices than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers,” the Brooks Brothers class action states.
Brooks Brothers class action claims shirts contain ‘significant amount’ of less-expensive cotton
Testing of the Brooks Brothers dress shirts showed that “the cotton used in the Product is not only Supima cotton but contains a significant amount of less expensive shorter cotton fibers and cotton byproductfibers,” the Brooks Brothers class action alleges.
Weeks argues that, by allegedly failing to disclose that the dress shirts contained less Supima cotton than advertised, Brooks Brothers violated the Textile Fiber Products Identification Act and the Magnuson Moss Warranty Act.
He also accuses Brooks Brothers of fraud, unjust enrichment and violations of New York General Business Law and multiple state consumer fraud acts.
Weeks demands a jury trial and requests declaratory relief along with an award of monetary, statutory and/or punitive damages for herself and all class members.
She wants to represent a Colorado class and multistate consumer fraud class of individuals who purchased the Brooks Brothers brand white Fitted Non-Iron Stretch Supima Cotton Dress Shirts.
A consumer filed a similar class action lawsuit against Ralph Lauren in May, arguing the company falsely advertises that some of its sweaters are made from Pima cotton.
