A $1.25 million Utz, Bachman class action settlement has been secured for consumers who challenged the snack makers’ claims that its chips, pretzels and pork rinds are “all natural.”

Class Members include those who purchased Utz and/or Bachman snack products labeled as “all natural” between Dec. 30, 2010 and March 30, 2019. Eligible products include:

  • Utz Branded Potato Chips
  • Utz Branded Baked Potato Chips
  • Utz Branded Pretzels
  • Utz Branded Popcorn
  • Utz Branded Tortillas
  • Utz Branded Snack Mixes
  • Utz Branded Salsas and Utz Dips
  • Utz Branded Cheese and Extruded Snacks
  • Utz Branded Pork Rinds
  • Bachman Branded Pretzels
  • Bachman Branded Potato Chips
  • Bachman Branded Tortilla Chips and Corn Chips
  • Bachman Branded Cheese Snacks
  • Bachman Branded Popcorn
  • Bachman Branded Salsa

Lead plaintiffs Matt DiFrancesco, Angela Mizzoni, and Lynn Marrapodi lodged the Utz, Bachman ‘All Natural’ snack class action lawsuit after learning that the products allegedly contained artificial ingredients and/or genetically modified organisms (GMOs). The plaintiffs say they would never have agreed to purchase or pay as much for the items had they known.

According to the Utz, Bachman class action, Utz labeled certain snacks as “all natural,” “natural,” “non-GMO,” or “non synthetic,” despite including non-natural ingredients in the products.

The plaintiffs accused Utz of capitalizing on consumers’ perception of natural foods as healthier than foods containing GMOs or artificial ingredients.

Utz agreed to pay $1.25 million to settle the class action lawsuit. Under the terms of the settlement, Class Members are expected to receive up to $20 for each valid claim. Claims are limited to 10 eligible products and only one Claim Form per household can be submitted.

In addition, the snack company has agreed to stop using the terms “natural” and “all natural” on its labeling.

In order to benefit from the Utz, Bachman snack class action settlement, Class Members must submit a Claim Form online or via mail, and provide their name, address, phone number and email address.

The deadline for Class Members to object to or opt out of the settlement is June 13, 2019.

Who’s Eligible

Class Members include those who purchased eligible Utz or Bachman branded products between Dec. 30, 2010 and March 30, 2019.

Potential Award

Up to $20.

Class Members are expected to receive $2 per item purchased, up to $20 per household.

Proof of Purchase

Not required. However, the “Settlement Administrator has the right to request verification of the purchase of Eligible Products, including, but not limited to, documentation demonstrating purchase of any or all of the Eligible Products purchased during the Class Period. If a Class Member does not timely comply with and/or is unable to timely produce documentation to substantiate and/or verify the information on the Claim Form, the Claim shall be disqualified.”

    I keep a google spreadsheet of all class actions I file, then update…..perhaps denied, paid, etc.
    This one I filed in April 2019
    Aug 2023 finally get a check
    Yep!…..Just like everyone else… $1.15
    so 4 + years later, get my settlement.
    Hmmm…..what to do with $1.15…….. ??
