NIBCO recently agreed to pay $43.5 million to settle claims that their plumbing products are prone to causing leaks which damage property.

The NIBCO fixture settlement was reached in late October and will cover damage that has occurred since Jan. 1, 2005.

In 2013, plaintiffs Kimberly and Alan Cole along with James Monica filed the NIBCO class action lawsuit over claims that its PEX plumbing tubes, brass fittings and stainless steel clamps suffer from a manufacturing defect.

The Coles say they discovered water leaks in their new home, 18 months after the PEX tubing was installed. Allegedly, a plumber found a crack within the tubing.

The plaintiffs say that there were several more occasions when the NIBCO plumbing leaked causing water damage throughout their home. According to the class action, NIBCO has declined to replace the Coles’ plumbing or reimburse them for the damage caused.

“The PEX Product Defects have caused plumbing systems to catastrophically fail and release water, which has caused and will continue to cause Plaintiffs and the Class to incur damages through no fault of their own,” the NIBCO class action lawsuit states.

According to the NIBCO class action settlement, Class Members eligible for compensation include consumers who owned or occupied a structure containing NIBCO plumbing fixtures since Jan. 1, 2005 and either have unreimbursed costs from water damage or costs from repairing water damage.

Additionally, compensation will be available for six years after the beginning of the settlement to compensate homeowners for future damage to property, if applicable.

If Class Members file a valid claim with sufficient supporting documents, they may be able to collect between 25 and 70 percent of their monetary losses due to water damage.

“The proposed settlement is an excellent result for property owners,” plaintiff counsel said in a statement. “It provides substantial relief for past and future failures that are related to the products at issue, including the option for a replumb.”

Class Members who want to exclude themselves from the terms of this settlement or object to it, must do so in writing by Feb. 27, 2019.

Who’s Eligible

Consumers who owned or occupied a residential or commercial structure since Jan. 1, 2005 which contained or contains NIBCO’s Pex Tubing, Fittings or Clamps and have unreimbursed costs or damages resulting from water leaking from one of these products, or have repaired or paid to repair damage resulting from water leaking from one of these products in one of these structures.

Potential Award

Between 25 and 70 percent of property damage which occurred.

Proof of Purchase

Supporting documentation and information, if applicable:

  • Name and policy number of homeowner’s insurance at time of leak;
  • Amount and/or receipts for repairs already paid;
  • Repair estimates for repairs not yet completed;
  • Inspection reports;
  • Bills of Sale, purchase orders;
  • Builder or plumbing records;
  • Correspondence, report, or testimony from a plumber, engineer, architect, or home inspector identifying tubing, fitting, and/or clamps on the property;
  • Photographs

    I have filed a consumer claim for Class Action Settlement NIBCO PEX 1006 Tubing, F1807 Fittings, and Stainless Steel Clamps and they keep making excuses to not reimburse me. Now they are threatening to drop my claim in two weeks.

    I’ve ‘only’ had 4 over time. However, I never received a dime , although I made a claim. And my insurance ‘Mercury’, just dropped my mortgage insurance due the water issues.. I’m so at a loss of what to do. Crazy stupid. – Good for the one who sold their house!!

    I live near Pensacola, FL and wanted to know if anyone have re-plumbed or re-piped their home threw the settlement, per there claim if you had more then 3 leaks. We filed a claim and are still waiting on claims administration. Last heard from claims dept in February.
    What plumbing company did the settlement use? We are still waiting!! We have had about 14 leaks and counting since 2012. We have not received anything ( no reimbursements of funds or plumbing pipes handled). Just needing any form of HELP!!

      They started sending out 25% of your total claim as a first installment. I recieved mine in April. As for when the balance (final) installment goes out, all the letter said was the balance would be paid “at the end of the claims period”

        Email response from claims administrator: The Court granted Final Approval to the Settlement as of April 11, 2019. The Effective Date of the Settlement was May 16, 2019. The deadline for Past Property Damage Claims to be filed is October 15, 2019, and benefit distribution is currently estimated to begin this winter.

    What do you do if you have been told you do have these pipes but you have had no major damage as of yet. Do you just have to “wait” until the damage occurs?
