JPMorgan Chase Bank NA (Chase) has agreed to pay $3.75 million to resolve a proposed nationwide class action that alleges the bank violated the Telephone Consumer Protection Act.
Plaintiffs Michelle James, Nichole Seniuk, and Holly Mochrie filed the proposed class action lawsuit against Chase in October 2015, claiming the bank violated the TCPA by placing autodialed calls to cellular telephone numbers that were reassigned from Chase customers to new cell phone subscribers and as a result the company did not have the call recipients’ prior express consent to make such calls.
Court records show that from Jan. 1, 2014 through Mar. 22, 2016, Chase allegedly called nearly 675,000 unique cell phone numbers that were originally associated with consumer accounts, but were wrong or reassigned numbers at the time of the call.
In those cases, Chase would make a notation indicating that they called a wrong or reassigned number. Chase also had a policy that once it placed that notation on an account indicating a wrong number, it would immediately stop calling that phone number.
Under the terms of the JPMorgan Chase Bank TCPA settlement, participating Class Members will receive a pro rata share of the $3.75 million settlement fund, after expenses are deducted.
While the exact amount each individual will receive is unknown, it is expected that Class Members who submit a valid and timely claim are likely to receive between $45 and $75, after deducting notice and administration costs, attorneys’ fees, and incentive awards for each of the three class representatives.
According to the settlement agreement, the reimbursement of class counsel’s expenses is not to exceed $15,000, and also stipulates an award of attorneys’ fees not to exceed 30 percent of the settlement fund. In addition, the deal awards the three class representatives $5,000 each for their role in bringing the TCPA class action lawsuit.
The settlement does not mean that Chase is admitting to, or liable for, any TCPA violations.
Class Members who wish to exclude themselves or object to the terms of the settlement must do so by Mar. 21, 2017.
Who’s Eligible
You are a member of this class if you received calls from Chase between Jan. 1, 2014 and Mar. 22, 2016 that:
- were directed to a phone number assigned to a cellular telephone service,
- were wrong number calls – in that the subscriber or customary user of the phone number called was different from the party that Chase was trying to reach,
- were placed using an automatic telephone dialing system, and
- were directed to a phone number associated with a Chase deposit account according to Chase’s records.

$45 – $75 (estimated)

Claimants must supply the telephone number(s) on which they received the call.

Never got my check all I got was a postcard telling me I would get check
My check was never cashed nor deposited and the void date was December 27, 2017. How can I request to get my check reissued. I’ve called the 18442254535 number but that was no help.
I received the letter to be a part of the settlement however, shortly thereafter i moved. I received a check last week but it states i cannot deposit after 12/27/2017. How can i go about having another check reissued due to address change? Pls assist. Thank you!

Just 3weeks ago my husband got scammed n chase for 4 years should have known that we didnt deposit money online….so the accepted this check made us negative 950.00 even though I have a theft report like they told us too ,and they took my whole paycheck and now I’m suffering with no food or any essentials after they said the account was frozen nothing could go on or out….can y’all help
