Dun and Bradstreet

Dun & Bradstreet Credibility Corp., a business credit report firm, has agreed to a $10.5 million settlement in a class action case in which plaintiffs allege violations of the Telephone Consumer Protection Act (TCPA).

Dun & Bradstreet collects commercial data about credit history and sells that data to businesses. The company has access to more 235 million companies in 200 countries.

The purpose of the TCPA is to protect consumers from unsolicited telemarketing calls. Specifically, the TCPA regulates the use of automated telephone equipment or “autodialers” to make any call to a wireless number for non-emergency purposes or in the absence of prior express consent of the recipient.

Lead plaintiff Jeffrey Thomas, who initially filed the class action lawsuit in Oregon, claimed that Dun & Bradstreet continued to call him on his cell phone even after having asked to be added to their do-not-call list and to not contact him regarding any services offered by DBCC.

However, the lawsuit stated that DBCC persisted in calling Thomas and other Class Members repeatedly on several occasions between Apr. 28, 2011 and Jan. 31, 2016 using autodialing software without prior express consent while conducting a telemarketing campaign.

Under the terms of the Dun & Bradstreet Credibility Corp TCPA settlement, it is estimated that the nearly 1.1 million Class Members will receive a settlement award between $60 and $120.

The $10.5 million settlement also includes attorneys’ fees of up to 30 percent or no more than $3.15 million, a $10,000 incentive award to Thomas, and administration costs.

Any residual amount under $200,000 remaining after all the payments included in the settlement are made will be donated to a nonprofit selected by the parties and approved by the Court.

Additionally, DBCC has agreed to initiate certain practice changes in order to prevent TCPA violations in the future.

As part of the settlement, DBCC denies the allegations and neither party admitted wrongdoing.

Class Members who wish to exclude themselves or object to the terms of the settlement must do so by Jan. 7, 2017.

Who’s Eligible

Under the terms of the Dun & Bradstreet Credibility Corp. class action settlement, all individuals who received a non-emergency call to their cell phone from or on behalf of DBCC or its related entities via an automatic telephone dialing system between Apr. 28, 2011 and Jan. 31, 2016 are eligible for relief.

Potential Award

$60 – $120

It is estimated that Class Members will receive between $60 and $120 per claim, but the final cash award will depend on the total number of valid and timely claims submitted.

    Dun and Bradstreet called me again yesterday and acknowledged that I am on their do not call list. I filed another complaint with the FCC, wondering when they will clean up their act.
