tcpa-spam-text.Amerigroup Insurance may be, according to reports, sending automatic unwanted text messages that violate the Telephone Consumer Protection Act, or TCPA.

Amerigroup Insurance is a health care coverage company that works with patients using Medicaid and Medicare.

Amerigroup Insurance Texts

Several people who have Amerigroup insurance plans have come forward, claiming to have received a number of unwanted text messages from Amerigroup insurance.

These Amerigroup text messages include texts that say things like “This is Amerigroup Washington, Inc., your health plan. We’d like to text with you,” and “Amerigroup: Many people don’t know why they need to go to the doctor for a checkup when they’re not sick. To learn why, text WHY.”

Amerigroup even advertises that it conducts what it refers to as an “annual member outreach campaign” to its health plan customers. The outreach campaign includes, according to Amerigroup itself, “automated outbound telephone calls [and] text messages.”

Even if a consumer has Amerigroup Insurance, this does not mean that the consumer has given consent to receive such text messages.

 

The Telephone Consumer Protection Act

Amerigroup Insurance is currently being investigated to determine whether the company has violated the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act does not allow companies to send their customers unwanted or unsolicited text messages or autodial calls without prior express consent. Each individual violation of the TCPA—for instance, a single illegal text—may be worth between $500 and $1,500 to the injured consumer.

The Telephone Consumer Protection Act (TCPA) was first enacted in 1991, and was intended to protect consumers from unwanted solicitation. While technology has changed since the TCPA was first created, the wording has expanded to include emerging technologies, and the goal of protecting consumers has remained the same.

The focus of the TCPA is on robocalling, or using an automated dialer or pre-recorded messaging system in order to contact consumers with unwanted and unsolicited phone or text messages.

TCPA violations such as unsolicited text message spam from companies like Amerigroup Insurance are not only annoying, but can also cost consumers money depending on what kind of phone plan they have.

Consumers who report TCPA violations like unwanted text messages from companies like Amerigroup Insurance may receive between $500 and $1,500 per individual violation.

It is important to keep records of each TCPA violation. Keep all text messages and phone records that you believe are TCPA violations, as well as a written record.

    Amerigroup (consistent care washington) texts and robo voicemails me almost every day. The latest one says they can cure me and I let them cure me they’ll give me a 50 dollar gift card. I havent been on Medicaid for over 3 years now. It is also concerning that they put medical i fo in text messages when they dont even know if it’s me they are texting.

    I have received multiple text messages from amerigroup. It is concerning because if they had the wrong phone number they would have been giving my private information to another person. Also, one of the messages sent gave me my PCP information and included a link to a website where I could “change my PCP. When I clicked on the link my browser blocked it because it was “unsafe”. The message from my browser said “Attackers might be trying to steal your information from amerigroup.ly (for example, passwords, messages, or credit cards)”. So, not only am I receiving text messages that I did not sign up for, but they are also sending me links that are not safe or protected websites.
