West Shore Home agreed to pay over $1.3 million as part of a class action lawsuit settlement to resolve claims it violated the Telephone Consumer Protection Act (TCPA) with unsolicited pre-recorded phone calls.

The settlement benefits individuals whose phone numbers were obtained by West Shore Home as part of a Facebook advertising campaign and who received one or more pre-recorded calls two or more times in a 12-month period between Nov. 15, 2016, and Feb. 15, 2022. In order to be eligible for the settlement, consumers’ numbers must have been registered with the National Do Not Call Registry for over 30 days before receiving these calls. 

West Shore Home is a home-remodeling company that offers a number of services including bathroom remodels, windows, and doors. According to the company’s website, the customer is West Shore Home’s top priority throughout the entire process.

Despite these claims, West Shore Home allegedly violated customer rights with unsolicited telemarketing claims.

According to a 2020 class action lawsuit, West Shore Home collected customer phone numbers through an online advertising campaign. Then, without getting consent, the company allegedly called customers and left pre-recorded messages advertising its $5,000 sweepstakes drawing. These calls were even placed to phone numbers on the national Do Not Call Registry, the plaintiff contends.  

Online complaints claim the company called consumers at all hours of the day, sometimes multiple times a day. The plaintiff in the case says she received several calls from West Shore Home within a 10-day period, each advertising the company’s sweepstakes drawing. 

According to the woman, she never provided her consent to have West Shore Home call her and even previously registered her phone number with the National Do Not Call Registry to avoid these sorts of telemarketing calls.

According to the class action lawsuit, West Shore Home violated the federal TCPA with its unsolicited phone calls. As a result, the plaintiff sought up to $1,500 per each violation on behalf of herself and a Class of other consumers.

The company hasn’t admitted any wrongdoing but agreed to resolve these allegations with a class action settlement of nearly $1.35 million.

Under the terms of the settlement, Class Members can receive a cash payment from the established settlement fund. 

Exact payment amounts will vary depending on the number of claims filed with the settlement. The more Class Members who participate in the settlement, the lower payments will be.

The deadline for exclusion and objection is May 16, 2022. 

The final approval hearing for the settlement is scheduled for May 25, 2022.

In order to receive a payment from the settlement, Class Members must submit a valid claim form by May 16, 2022.
