Tyson and Pilgrim’s Pride have reached settlements in a class action lawsuit over alleged broiler chicken price-fixing, adding $155 million to the total settlement proceeds.
Anyone who purchased broiler chicken directly from any producer identified in the class action lawsuit, or their subsidiaries or affiliates, for use or delivery in the United States from at least Jan. 1, 2008, to Dec. 20, 2019, is part of the Class.
Plaintiffs in a class action lawsuit had alleged the defendants and others raised and fixed the price of broiler chicken and broiler chicken products beginning by at least Jan. 1, 2008.
The settling defendants have not admitted any wrongdoing, and a court has not ruled in favor of the plaintiffs or defendants.
A person or entity is considered a direct purchaser if the product or service at issue — in this case, broiler chickens — was purchased directly from a defendant (or related parties, such as a defendant’s subsidiaries) rather than through an intermediary source such as a retail store or wholesaler, according to Financial Discovery Strategies.
The Court previously approved settlements with Fieldale Farms, Peco, George’s, and Amick., and has now approved settlements with Tyson and Pilgrim’s Pride.
Tyson will pay $80 million, while Pilgrim’s Pride has agreed to pay $75 million.
After attorney’s fees and other expenses are paid from the settlement fund, Class Members submitting valid claim forms and do not exclude themselves will receive a pro rata portion of the fund based on their broiler chicken purchases during the Class Period.
Class Members were sent pre-filled claim forms reflecting the amount of their broiler chicken purchases from each producer, based on the producers’ records.
If the pre-populated purchase amount is accurate, Class Members can accept them. However, if the Class Member believes the amount is not accurate, they can challenge the amount by completing a Purchase Audit Request and providing the related documentation.
These revised amounts will be reviewed by the settlement administrator, co-lead counsel, and the Court.
Consumers who believe they are Class Members but did not receive a claim form can request on the settlement website or by writing to the settlement administrator by mail or email.
Class Members who receive multiple claim forms must submit each one or take steps to make sure all purchases on the claim forms are accounted for in their submission.
A final approval hearing will be held June 29, 2021.
Class Members who wish to object to or opt out of the broiler chicken settlement must do so by May 17, 2021.
The deadline to file a claim is also May 17, 2021.
